Max income with va disability.

I'm about 2 months into the meb process now, just finished all the qtc exams last week, though I'll probably appeal one because of the doctors demeanor and going thru the motions attitude.

While I do want to get a percentage equal to my disability (complete loss of use of my right ankle/foot) and moderate depression/nightmares from 2 horrible surgeries. I'm worried that if I'm given a 100% combined rating, that either I or my wife and I, will be limited in our income for the rest of life. I've looked thru regs endlessly, trying to see if there's a max yearly\ monthly income before VA benefits start being withheld or garnished. I can't find any reg, but always being told by others in my unit and people going thru process that there is a limit. Any help in this would be greatly appreciated.
 
If the 100% rating is based on the combination of conditions (scheduler) there is no limit. If the 100% is based on individual unemployability your income would be limited to an amount less than that considered gainful employment. If you are IU and you make too much, you would simply lose the IU status and return to whatever your schedular VA rating is.

Thank you Mike, really puts my mind at ease. wife Is working towards an engineering degree and we're both of the mentality that money we make or earn, is ours to do with as we please and not a community chest sorta thing. And if she makes bank with an engineering job, I didn't want to mess with our finances trying to even out so I don't get compensated for my injury. Thank you again for the help!

Unless you are rated unemployable (which doesn't require 100%) you can work and make however much income your jobs see fit even if your rated 100%!!

If you are rated as 100% Permanent and Total, you can go out and become the CEO of Microsoft and make billions a year and you will still receive your VA benefits.

If you get 100% Unemployable then you cannot work, you may collect SSDI, also you and your spouse can apply for the CareGiver program. This alone will support your family easily.

Pleased to read that you are moving along within the DoD IDES MEB/PEB process; good deal! :)

Indeed, utilize all available opportunities to submit a rebuttal and/or an appeal if you feel the specific actions were not completed within DoD IDES proper specifications; I did and received favorable MEB results.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."
