Lose Benefits? VA "may" drop rating..plz help/answer

I am 100/100 n VA wants to drop my seizure code 8914 Epilepsy, psychomotor which is rated as "Psychomotor seizures will be rated as major seizures"
&
"General Rating Formula for Major and Minor Epileptic Seizures:
Averaging at least 1 major seizure per month over the last year........ 100"

BUT the stupid MOTHER FX#KER at the C&P thought the few seizures I was having a week were "minor" because he was an idiot and didn't know the difference and I didn't think I had to check his work until I got a letter in the mail stating my ratings were getting lowered. ANYWAYS I went to appeal it and haven't heard anything yet. So my question is what benefits will I lose besides the obvious which is pay, btw they want to reduce my code 8914 to a 50% rating.

( I am just preparing for the worse case scenario but am still fighting it. I also contacted the VSO and plan to use them to fight to raise my TBI % because the VA screwed me on that big time by giving me 10% even though I had brain damage, a coma, 2 medivac from Iraq, 2 months hospitalization, brain hemorrhaging, and more n other jacked up issues)

Any tips info or anything would be greatly appreciated.

Wow; sorry to hear this type of information albeit as based upon my VBA experiences with C&P examinations, it does occur unfortunately. :mad:

Hmm, well, it seems that you shall potentially lose any DoVA disability compensation benefits associated with having a VA 100% total rating to include any federal, state and local government additional benefits specifically for VA 100% rating awardees.

At this point, were you placed on DoD PDRL or DoD TDRL? If DoD TDRL and if your TDRL re-evaluation is forthcoming, there also may or may not be a monetary affect (e.g., reduction) in your DoD military disability retirement compensation if applicable; not for sure.

Indeed, as I have always mentioned, never default acceptance to any injustices; fight then continue to fight some more until receipt of your desired outcomes supportable via all available medical evidence and/or medical documentation!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Hello Jared Lee,
after reading your post I can see how frustrated you are and I would be to! But do you have any other medical conditions that will help to keep your ratings at 100% with this new change? Just as Warrior644 stated do not accept any injustices! You must continue to fight until you get what you want especially if you were TDRL and this is the PDRL decision.
 
The extras at 100% are the ID card, CHAMPVA, dental and chapter 35 DEA. For some, these are not used, for others, they can be a big deal. I would send along something from your treating doc/neuro stating that the seizures are classified as major, and why.

I would be cautious about the TBI argument. Pyramiding rules says you can only get rated once for a symptom. If your seizures are include in the TBI the max rating is 100%. If your seizures are included separately your max rating is 100% + the TBI rating. It is to your advantage to have the conditions seen as separate in the majority of cases. The problem, I suspect, is not the rating codes used, but only in the C&P doc changing your seizures from major to minor and I would only seek to correct that misinformation and not go running down side streets.
