Just the Beginning

Bend over, here it comes. Call from PEBLO today, the IPEB people want orders for reference during my injury, thought we had that fixed the the LOD. Then she tells me they are trying to figure out if the cancer dev loped on active duty or aggravated by AD service.....hmmm, is one better than the other?
 
Both are pretty much the same thing, the injury must have occurred during, or was aggravated by active duty service.

Odd thing is that the PEBLO should have all of your active duty orders since the beginning of your enlistment. I know I had to provide mine (as well as copies to the WTU) many times.
 
It sounds like they are trying to say it wasn't service connected and you need to prove otherwise.
 
More than likely they want the orders to tie the cancer to a presumptive condition. If there is any potential exposure to depleted uranium then the presumption should be granted.
 
I thought the LOD already ties it.
 
So my benefits site says "pending decision approval" but under needed from you it says Request 2, PEB for severance pay disability. EEK, I hope its not just severance pay. Oh yeah, and the doctors agreed with the LOD, the cancer is tied to my active duty service.
 
You can only get severance if you're found unfitting for things that total less than 30%. I can't imagine that (1) you'd be less than 30%, and (2) they'd be playing a hand towards severance without having the ratings yet from the VA.
 
My Ebennies claim shows my "Pending Decision Approval" under compensation, not pension, is this normal?
 
MEDCON approved, 6 months first order with indefinite extensions until retired. Got a personal call from Randolph.

And for future reference, INCAP is taxed like active duty pay. No taxes on BAH/BAS, at least in the paychecks.
 
Concerned VA rep called me at home on Saturday, told me I'm getting hosed by the VA, all claims denied except 0% for hypertension. The VBA wrote I didn't claim anything within the first year of being separated from active duty therefore void.......awesome.
 
I was told the VA also told the DOD I was awarded 0%, this could be awesome. I'm officially unfit but allowed nothing. SO much for 17 years as an F-16 pilot. Not officially through the PUEBLO yet, people are fighting on my behalf behind the scenes, lets hope and pray.
 
Gone, have to be cancer free for 6 months to get it back
 
SSD approved (1st try), FPEB is in February at Randolph!
 
How long was it to get a decision?

What documents did you provide?
 
3 weeks to get a decision, no wait for an appointment, went in uniform, took every piece of medical documentation we had plus the business cards of every doctor I see, the med clinic at my ANG base and the med clinic at the active duty base. The approved LOD and my MEDCON orders. I was diagnosed in Aug 15, they will backpay me from Feb 16, that'll be interesting because I've only been on MEDCON since September/August 16, we'll see!
 
Lawyer got decision reversed without going to the board, the IDES system is supposedly running like I am ILOD, I'll check in with more info
 
So the FPEB threw my package back to the VA and told them they screwed up, this is ILOD, rate him and fix your crap. Should be interesting.
