Just started the MEB process ...

Hello,

First, sorry for the long post. If you have the time, please read and give me your opinion on the matter below. Any information would be greatly appreciated. A little background on me ... I am a 28 year old CPT, IN, 6 years in service, about to be 7 years, coming up on 5 years active and 2 years prior service in the GA Army National Guard.

I recently initiated MEB. I was told by my PEBLO that the VA would be calling soon and that I should have a list of everything I would like to claim... which kind of confuses me. When I file a claim, say for my back, do I just say back pain? Or would I claim each back problem as a different claim, for example, Lumbar Spondylosis, degenerative disk disease, herniated disks, thecal sac compression, annular tears, neuroforaminal narrowing .... I currently have a P3 profile for the conditions listed below as well as an H2 condition. I can not be exposed to noise in excess of 85 dBA.

Below is the MRI results and the overall recommendation of the Neurologist here at Ft. Benning.

Here is what my findings were from my MRI:

Mild disc desiccation and disc space height loss are noted at L4-L5. A transitional vertebra (lumbarized S1) was noted on the radiographs. The conus terminates at L1. Modic 1/2 change noted in L5-S1. Otherwise no significant focal abnormal marros signal is identified throughout the limits of the examination.
L4-L5: a bulging disc/right paracentral disc bulge causes mild thecal sac compression and mass effect on the exiting right L4 nerve root. There is a tiny annular tear.
L5-S1: A circumferential/left paracentral disc bulge causes mild to moderate thecal sac compression and mild mass effect on the exiting S1 nerve roots, left greater than right. There is minimal right neuroforaminal narrowing.
Impression:spondylitic changes and bulging discs as above.

Here is the write up from the neurologist:

1. Lumbar Spondylosis 721.3: The low level of his lumbar symptoms at low physical exertion really means that he needs to permanently limit his exertion. From an interventional standpoint, his symptoms do no rise above radiofrequency denervation The chromicity of his symptoms indicate that he would not obtain a long term axial pain relief from epidural injection. There is no good medication option and he does not require surgery.
My opinion is that the SM will not improve to the point to allow him to perfrom their militart duty within the year. As such, I would put them in permanent 3 category. Dr. XXX (Head of MEB) instructed me not to write permanent profiles that would initiate a medical board procedure. I would otherwise initiate MEB personally, but he wants this to be done by the PCM so that it will be more wholistic in scope I will restrict my concerns to the spine.

I understand that back pain is rated on ROM tests, which kind of makes me nervous. For the most part, I have no problem bending over and touching my toes. The level 10 pain doesnt really occur unless I do something strenuous... such as PT, rucking, ... and randomly happens just from bending over and doing absolutely nothing that you would think would strain it. On a day to day basis, my pain is generally a 1-2. Pain increases during prolonged periods of standing, sitting, or doing anything drastically increases while doing any strenuous activity like listed above.

Any tips on filing the initial claim with the VA and what to expect disability wise, if anything, would be greatly appreciated.

Sir, welcome to forum and sorry to hear about your injury. I was just medically retired with 70% from each DoD and the VA and my MEB was a pain, but it was a good lesson learned and I am glad that I have that experience so that I can share with others. When the VA MSC calls you and sets up the appointment, go with a list of EVERYTHING that you want to claim. They SHOULD have a copy of your medical records already from your PEBLO and PCM and if you say "back pain" then the doctors writing your narsum and conducting your exams know to check everything in your record and then test you for it. Unfortunately YES it is based off range of motion. My injury was brachial plexus neuropathy to my neck and shoulder, but I also claimed lower back pain from a nasty fall in Hawaii on a training mission. I went to the ER and claimed it a year later and I ended up having an additional 10% added to my disability because at a certain degree/angle it gave me some pain, although it was not a condition that would have deemed me "unfit".

My injury being neurological as well, I had MRIs and EMGs conducted and when the VA contracted doctor did the exam with range of motion and everything; she used the MRI results with the EMG to write up her findings as well as the ROM results, it is actually very beneficial, do not be nervous!

My only advice with the VA is to tell them anything that you have ever been to sick call for, any time you coughed weird or rolled your ankle and had Doc tape it up, I am not kidding. I have seen friends get out and then 6 months later have a bad cough and they had pnuemonia 3 years prior in the Hindu Kush mountains of Afghanistan and they never thought of getting it checked out thouroughly.
 
Sir, welcome to the forum. Take the advice of the people answering you. My MEB is stuck at the NARSUM point because I disagree with for various reasons. But when I went to the VA rep I listed everything I felt was wrong with me even if it wasn't documented. The reason for this if by any chance in the future the condition you listed does appear and is medically diagnosed you already started a claim on it. Perfect example for me, pain in left index finger. I believe taking care of a patient I fractured it but never had it medically diagnosed. Well, during my process they took an xray and I do have a fracture of my index finger. So however minute, list it.

Now I have a couple of dumb questions about claims ...

Do people claim dental stuff? For example, root canals? I think I have some sort of "disease" with my gums... I would have to look at my dental records.

Also, I have had a cyst (gross, I know) that has slowly but surely been getting bigger over the years located on the back of my neck. I went to try to have it removed 3 or 4 years ago and was told they couldnt because it was inflamed a little, and would cause an infection or something.

Do I claim that type of stuff too as well as my conditions I am being MEBed for?

I sure would claim it! It doesn't hurt to ask! My MSC listed EVERYTHING I told her about. Although you are being MEBed for a certain issue, cover the rest of your body from head to toe with whatever has been hurt/injured/abnormal!
 
Yes, claim them. What you need to do is see the dentist ASAP and let them take care of before you get out. Secondly, get the cycst removed now. If they give you a hard time tell them you want a second opinion. But tell them it is impeding with your neck motion due to it being painful. The nonsense about infection is just that...what do you think antibiotics are for?
This is just the start, stay informed and be proactive.
 
Been thinking and making a list of things to claim when I meet with the VA next week.

Would you claim any of the following?
- Pectus Excavatum
- Super dry/itchy skin on back and arms
- I have had two warts appear (One of my right index finger and one of my right shin) in the past year
- Concussion with loss of conciousness (This was not as a result of anything Army related... but did happen while I was in the Army. Jumped by 5 guys in downtown Savannah. I've for a police report and hospital documents from this. It happened in the past year)
- Small scar in about the length of a dime or nickel on my thumb from messing around with a weapon
- Cyst - I have been seen for it twice since being on active duty. It swole up once and was extremely painful and I think they gave me medicine for it. It eventually brought it down. I went to try to have it cut out once like i said in a previous post but they said they couldnt because it was inflamed.. but it is slowly but surely getting bigger again but it is not painful. Currently in the process of making an appointment to try to have it cut out again.

Lil hint for u

If u are in pain anywhere claim the pain
Pain is 10%
And yes u can claim dental problems
I claim TMJ and lost of all teeth cuz of the TMJ from gring n biting unreg.
