Just had first TDRL exam, ????

Hello brothers and sisters!
I am a TDRL Marine (E6/SSgt with 10 years active duty) and just had my first TDRL exam at Wright Patterson AFB.
I was put on TDRL rated at 40% in 2008 for (per PEB findings)

VA diagnostic codes 8299-8911
1-Recurrent presyncope and syncope (7802)
1.1-Cluster headaches (7840) (related category 2 diagnosis)
1.2-recurrent migraines with aura (34680) (related category 2 diagnosis)

Since being put on TDRL I was put on social security disability since I can't work, I have had to declare bankruptcy and I am VA 100%. My conditions have not changed since being put on TDRL, medical records reflect.

I had two appointments and I was seen by a AF neurologist and gave him all my records. Then I was seen by a AF cardiologist, however I did not have any records from a civilian cardiologist due to the fact when I was going through the MEB process the cardiologist said my syncope was not cardiogenic(not heart related) so I stopped seeing a cardiologist, hence no records to give.

1-Will the PEB consider this not continuing with my care? By no means have my conditions gotten any better but I was told it wasn't heart related so I just continued to see my civilian neurologist (which I go see on a monthly basis and gave the AF neurologist my records) since put on TDRL.

2- What does the PEB consider permanent? I have not gotten any better with multiple medication changes, I have an oxygen bottle at home, I practically live on vicodin, I take multiple medications and I can't work. I am just worried they will try to low ball me because I need the tricare for my continued care (I don't want to have to use the local VA, it is a dump!)

3-I was also told by the AF medical board office and my Marine Corp action officer that I don't get a PEBLO since I am on TDRL and I don't get to see the summary the 2 doctors are going to send the PEB, is this right? I though I get a PEBLO not some action officer and I get to see what is sent to the PEB?

I gave the AF neurologist my civilian medical records, migraine log that documents all syncope and cluster/migraine episodes, VA 100% award letter, and SSDI award letter. I just hope the AF doesn't lose anything I gave them before they send it off to the Navy PEB.

I am wondering where your syncope rating came from. I am diagnosed with POTS which causes syncope and have been unable to find a similar code in the VASRD. I looked up 7802 and that is for 2nd degree burns.

Sorry I was just putting what was on the PEB findings next to the unfitting conditions and forgot to put what was under the VA diagnostic codes block, it says 8299-8911.

This is certainly an issue. The TDRL process is severely flawed in the way the Navy and AF are treating it. You most certainly have the right to review your dictation. I would write the PEB at the NAVY yard and demand to see your dictation and all your DES files. WHen they decide on your case you can then appeal it and submit more documents if you wish. I would prepare to have to got to DC and go to a Formal PEB but exhaust he informal process first. Keep very detailed notes of how the condition effects your daily life and have other eithr in your family or that are close to you write statements verifying the impact and limitations it has on your life, also use your VA rating in your appeal to the board as evidence the Navy PEB should rate concurrent to VA, by law they are supposed to. Look up the DoD 1332.18, DoDI 1332.38 and the Oct 14 2008 and USC 1222a, these laws say your afforded a full and fair hearing, due process. I will try to be positive at first and hope they will either put me on PDRL or continue me on TDRL(which I won't mind).

I gave the neurologist my migraine log and would assume that should be enough detail on how it effects my daily life along with the medical records. Not sure what more I would be able to give them in a formal hearing other then letters from family or friends since I gave them my migraine log, medical records with monthly neurologist visits, VA award letter and SSDI award letter already.

So should I have a PEBLO or is the Marine Corp action officer all I get since I am on TDRL?

Also, I would asume if they send my summary to the PEB without me seeing it and not siging off on it and then they low balled me and I appealed it then went to formal, wouldn't that help my case since I am suppose to see the summary before they get it?


Hoping for the best I geuss.
