Are you able to find out if you can get IU before you leave the military?
To clarify my response. You do not have to be off active duty. Sorry for the confusion.Yes:
38 CFR 4.16(a) and 4.17
Where does it show that you don't have to be off active duty? That section just explains ho you would qualif for itTo clarify my response. You do not have to be off active duty. Sorry for the confusion.
No one receives VA compensation while on AD, but you can argue IU throughout the IDES. This can allow for DoD recognition and/or VA recognition.Where does it show that you don't have to be off active duty? That section just explains ho you would qualif for it
Thanks, I understand you can't receive compensation whole ad, just wanted to know that we could be proactive before we retire. No one receives VA compensation while on AD, but you can argue IU throughout the IDES. This can allow for DoD recognition and/or VA recognition.
That's my question. Right now I'm ad but not working, so that's why I thought it might be plausible to request it before separation. I suppose you can't actually ask for it if you haven't received your ratings. All this is just so confusing! The thing is, how to argue IU while ad, do you submit the form while waiting for ratings? they would not let me submit it during my initial MSC meeting, maybe submit it with a VARR request? hrrrm.
How would I request it as part of my ratings? I have psyched physical va appts next week. Is there something I should say at that time? You can request it as part of your ratings. But, until you have ratings that qualify you for IU, you cannot be awarded it. So, as far as actually being "awarded" it, you cannot get that until your case DVA case is finalized, which happens after you are separated or retired. The issues are slightly different for reservists who have previously been rated and are going through IDES, in my opinion. I think it makes sense to argue TDIU if you think you are unemployable. (Along with applying for SSDI- which, if awarded, would help the TDIU argument).
