Issues with VA Appt notes

Have you been diagnosed by a rheumatologist for Fibro? If so, I would think. Regardless of what she thinks, the VA should still rate it based on med records as long as they are current.

Unfortunately, it seems to not be the case for some medical conditions that require an official medical diagnosis by a medical specialty doctor (clinician).

For example, I have all the symptoms for Irritable Bowel Syndrome (IBS) and it is well-documented within my STR but since I didn't have an official medical diagnosis from a gastroenterologist at the time when my DoD IDES case file was being review by the DoVA D-RAS, they yielded an evaluation of "Not service connected - no diagnosis" for the claimed IBS medical condition.

Since then, I have received an official IBS medical diagnosis by a gastroenterologist and my symptomatology should fall within the VASRD severe range yielding a DoVA 30% rating in my opinion.

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Did you have MRIs of you neck and back?

Sounds like she is trying to dismiss you fibro all together.
That's what I was thinking Amy. That's the frustrating part because I have issues with this that cause me issues everyday.
 
Indeed, and as a direct result, I am still implementing my authorized rights under the DoD IDES appeal process at this point in time.

To that extent, never default acceptance to potential injustice; fight then continue to fight some more is my stance on any erroneous situation!

Unfortunately, it's potentially an additional three to six months dependent upon the outcome of the forthcoming FPEB hearing appeal which was due on 26 Dec 13. But, my assigned military SPEBC attorney never contacted me after stating the DA Form 199-1 was completed (and didn't provide a copy as promised) to assist with writing the FPEB hearing appeal as requested by me; not good, not good at all! WTH! :mad:

As such, I shall continue to implement my authorized rights via the DoD IDES appeal process until success resolution or exhaustion of all of my DoD IDES process appeal rights while on active duty; I shall not be denied for sure! :)
