Is 100% DOD worth the fight?

Got a proposed rating of 80% and PDRL from TDRL IPEB 1.5 years in - pulled it off myfss site so idk how valid it is as I havent gotten official notification. 70% MDD, 30% Chrons - basically no change from day they TDRL'd me. Thing is VA reevaluated me as 100% MDD/PTSD last Fall and arguably my Chrons is currently in remission so would be like 10% realistically if looked at again based of current VARSD.

Spoke with disability attorney over a year ago about TDRL and was informed that DOD must match VA rating if member was reevaluated by VA within 18 months of being reevaluated by DOD - according the secretary of the branch.

If they threw away Chrons for military purposes that still puts me at 100% dod based of MH rating - catch is they may toss me back on TDRL(If they reevaluate me again I doublt my VA rating will hold due to age so ill be at the mercy of DOD LDES). I am paranoid whether I am missing out on any future money(Should some law changes would occur raising 75% cap) as my pension is higher than VA payout and obviously set for life where VA can fluctuate.

Should I not be greedy and just take the deal and run or raise the concern/fight it? I do plan to consult an attorney regardless in case rules changed but would like a variety of opinions if possible.

Thank you.

So, you are willing to risk your currently maxed out permanent DoD percentage and your current 100% VA rating in hopes that sometime in the future they may change a law in the exact way you hope it would turn out?

Sigh... these people hold up the process for everyone else. Paranoia, making up law changes that don't exist, has a pension and all other benefits imaginable, yet is still unsatisfied. Some people can never be happy.

Accept it! Its a no brainer. You are maxed at 75%. You have nothing to gain and everything to lose. You do know that a FPEB to challenge TDRL to PDRL finding means everything is on the table. They can decide your ratings are lower. It would be very stupid to not accept a finding in PDRL where you max out compensation just for the hope that a future law MIGHT get you more compensation.

Thank you for candid responses. Rational thought is kind of hard for me nowadays so i get into bullshit rabbit holes. Ill sign the paperwork and move on with my life.

Ill still consult with ODC but you guys helped me with my decision, so thank you.

Figured restating your thought as a question would help make it clear the risk you were going to take with likely no upside.
We all have our days....

Go enjoy what you have earned. It's ok to rest now.
