The answer to your question is yes, you will get your DOD pension and you full VA disability pay (the definition of CRDP).

SEC. 2. Eligibility of disability retirees with fewer than 20 years of service and a combat-related disability for concurrent receipt of veterans' disability compensation and retired pay.

Thanks. Interesting your take. I kind of read it to mean that if the MAJ Richard Star act passed I would get the full amount of my intended DoD pension and full amount of my VA pension. Obviously, it would render the CSRC obsolete.

Hi,

Sometimes amendments ignore and do not change existing laws and limitations. Example: The recent SOTO decision does not change the law that causes a “CRSC clutch“ that has a flawed computation for pre-2013 CRSC computations for CRSC for CH 61 retirees.

The CRSC should not be obsolete as it does not just apply to CH. 61 retirees. I had a regular retirement in 1991 and all my retirement pay eventually became CRSC and nontaxable.

Associated remark. There is no reason for CRSC to end. CRSC applies to non-CH retirees such as me in addition to CH 61 retirees. Actually, CRSC pre-dates CRDP: CRSC Enacted by Congress on December 2, 2002 . CRDP: Passed by Congress in 2004.

What the legislation does​


The Major Richard Star Act would allow any disabled veteran to receive both their full disability and retirement pay, regardless of how many years they served.

The Senate version was introduced on May 22 as S. 344, by Sen. Jon Tester (D-MT). The House version was introduced two days later on May 24 as H.R. 1282, by Rep. Gus Bilirakis (R-FL12).

Comment: It will be interesting to see what is in the weeds if this legislation is approved. All of the Byzantine limitations in the current law(s) were imposed by Congress in a money-saving endeavor.

My interpretation/summary of The Military Officers Association of America {MOOA} web page discussion of the Star Act.
The Star Act impacts only CH 61 retirees with combat related disabilities. (e.g., "According to the DoD Office of the Actuary, the Star Act would support over 48,000 combat-injured veterans with concurrent receipt of medical retired pay and VA disability. These individuals, often seriously disabled, are subject to an offset where their medical retirement pay is reduced for every dollar of VA disability received. In some cases, their retirement pay is completely reduced. "

The Star Act does not affect retirees without combat related disabilities, nor does it impact any other retirees with 40% or less VA ratings.

As I mentioned earlier, it will be interesting to see what is in the weeds if this legislation is approved.
 
The MOAA video does an excellent job of explaining the benefits in this bill. So much so that I went to the website, signed up, and sent support letters to my senators. I did not realize at the time of my previous posts how much an impact it would have on me personally, so I can only imagine the impact it would have on other retirees as well. Hopefully we continue to make progress.

Well said. I'm a member of the MOPH and I can't tell you how frustrated I am with them right now.. They want to spend there time and resources handing out signs and proclamations like this city is a 'Purple Heart' city or this car dealership is a 'Purple Heart' car dealership... I have publicly questioned this with them. How does this help Purple Heart recipients or disable veterans for that matter?? We need veterans to band together and pressure them to do right by our veterans.. proclamations and signs don't cut it...

I too think they did a good job.

I hope the Star Act become law.

Meanwhile, lurking in the weeds is the problematic situation that the ACT establishes its own "special treatment" group, albeit deserved in my opinion. There has been little discussion about current retirees who have VA ratings 40% and below which do not qualify for CRDP. That was a money-savings element of previous concurrent receipt laws. Additionally, the discussion about the Star Act does not address the current limitation of CRDP to not exceed the dollar amount of the longevity portion of retired pay.

It will be interesting to see how this plays out. I hope some who have experience in computing concurrent receipt (DFAS) point out to the lawyers/Congresspersons who develop the new law(s) the various differences.

Same here. Cornyn and Cruz are terrible about really replying.. It's an automated response that says thanks for reaching out.. Shelia Jackson Lee is my rep here in Houston and she is terrible.. she's only interested if there is a camera involved.

This is good news... 218 is the minimum. Probably need a few above that just in case. Also, Pelosi has to allow it to the floor for a vote... In the Senate we need 60 votes. 55 is really close. I'm shocked senators Cruz and Cornyn from Texas haven't thrown their support behind it here in Texas considering they "support or veterans"...
 
We need to keep on "squeaking". There are Senators I have spoken with that will support this once the numbers are reached in the house.

The momentum is looking good!

I have reached out to all my former teammates across the nation and they are contacting their Congressmen and women to their respective states.
