Welcome again, everyone (well, as of now I am the only one registered here, but this is for all the future members). As I explained in the anouncement, I have created this site to provide US Military Servicemembers information about the MEB / PEB proccess. This is intended to be a one stop information resource center and discussion board.
This is my first message board/website, so please bear with me as I learn more about this board's software and how to improve the user experience. Please feel free to offer suggestions. I know I won't be able to please everyone, but I will listen to input.

This site has been very helpful so far. I intend to recommend this for anyone who is going through a PEB as it has good information/links that help explain the process better.

Does anyone know of an attorney that will represent me in an attempt to get a MEB/PEB with hopes of PDRL + CSRC or CRDP, whichever works out best pay-wise.

Yes, I get VA compensation and I know there will be an "off-set" of some kind, but I at least would like to investigate what my options/possibilities are.

When I was discharged medically, I SHOULD have been referred to LDES and sent to MEB/PEB, but was not.
 
Have you done the basic research yet to make sure it is worth your time? Such as if referred what the rating would be using the information at the time for LDES? How long did you serve? You have more to gain the longer you served. If you were in 2 years and then kicked out it may not be worth the trouble. CRSC is there to claw back money lost to VA offset but the cap is the value of your earned longevity pension which is calculated by active duty service time and your base monthly pay.

Also, even if no extra compensation Tricare is worth it alone. However, its good to know what you are fighting for and what you can expect to receive if you win. If you only served 2 years and the condition that should have put you in IDES with a 20% rating then I don't see a reason it would be worth it to even try to get it changed. Since any severance would be paid back from VA compensation meaning a net zero gain.

I was initially given 50% disability then have been since increased to 100% P&T + homebound. I have over 12 yr.

but DOD% uses only the VA ratings for unfit conditions. Most have only 1 condition that is unfit for service. The BCMR would base it off of your condition at the time of separation. It needs to be an error or injustice. That's the issue most Soldiers have. If they went along with it then it makes its darn near impossible to get it changed. I just read a case where a Soldier in the Army tried to get their combat related designation changed after the fact. The BCMR all voted no because they rescinded that challenge and accepted the findings. If you could have gone LDES and chose not to (sometimes the Soldier is given some input though its rare). Then you can't later on say hey wait! I should have done this instead! That isn't an error or injustice. Just a bad decision that you regret.

I completely understand, I wasn't given a choice, and the medical issue made me unfit. Injury to right shoulder/arm requiring several surgeries, in theather then more surgeries after MedEvac to LRMC at Lansthul. Lost most of use of right shoulder/arm/hand..and that is my dominant side as well as neck/cervical injuries requiring surgeries which cause limited ROM, Neuropathy & radiculopolthy in both Shoulders, arms & hands.

I am now being referred to the board a year later due to a condition that I am not rated for. My understanding is that if I were to be separated the VA would recoup any severance pay I received or there would be an offset if I were to be medically retired. The law states you cannot concurrently receive both for the same disability unless approved for CRSC. My question is how is it considered “double dipping” if I am retired on one condition but am already compensated at 100% for others?

It's not double dipping in your case. If you can reach 100% without the conditions that are found unfit then there will be no recoupment.

CRSC is a totally different thing and has no binding on the subject. CRSC isn't available to Soldiers who are medically separated with severance. So if you aren't medically retired you can't apply for and receive CRSC. CRSC is there to recoup the VA offset that is required when medically retired and receiving VA pay will offset that medical retirement pension. So no medical retirement = no CRSC. So getting severance is does not affect CRSC since it isn't applicable.
