I finally got the call from my PEBLO today. My packet is back and proposal of 30% DoD permanent. I think I deserve more for constant back and shoulder pain, and only being able to lift my dominant arm about 45 degrees after two surgeries. Any one know how long it would take if I tried to appeal ? I am more than likely just gonna accept it, after being almost a year in the meb process, and almost 6 months past my ets. I am so ready to have my freedom back and facial hair :) Any input would be greatly appreciated, thanks.
 
1. Can you prove you deserve higher?
2. Are you content(financially) with 30%?
3. You served X number of years and spent the last year dealing with the PEB. Will you regret not appealing later?
Just some questions I would ask myself.
 
Congrats on the findings and making the 30% threshold! From what I have heard, requesting an FPEB will usually take about a month or two until you get your hearing date. Then attend the FPEB, wait for their findings, etc. So, I would think that an appeal would likely add 2-4 months onto the process, but could be well worth the effort/delay if they increase your rating. Remember, however, that they could also lower your percentage...and only being at 30%, any lowering would put you in severance range vs retirement. Tough decision.

Take your file into the MEB attorneys at the post you are at. Their purpose for existence is to help people in your situation with this exact question. At least here at Fort Riley, they have a guy who seems like a good attorney to help us out. Good luck, congrats on the 30%.

The only complaint I have with 30% is that I cant do a lot of the actives I enjoy. I can't really throw a baseball/football. I can't swing a golf club, about all I can really do is fish, and play video games.
 
Once you retire out and get things set up on the "outside", start looking into physical therapy, muscle rehab, etc. Who knows, you might get back to somewhat normal again and be able to do the things you enjoy. There is nothing wrong with fishing and vides games....now fishing video games, maybe.:)
 
The thing is, the military does not consider your recreational activities - their only concern is whether or not you can do your job. If you were a complete vegetable but you could do your job in the military, you would get 0% DoD, but could get 100% VA. Like I said, I'd have the attorneys take a look at it...

What is your proposed VA rating? What is your current base pay? Do you have dependents? This information could help you figure out what course of action would be most beneficial. If you are a junior NCO or enlisted, chances are you will not make much more with a 10% gain on the DoD side, and you stand to lose a whole lot when it comes to access to TRICARE and other retiree benefits. Before you go through with the appeal, do the math and figure out exactly how much you stand to gain from an increase, vs. how much you stand to lose if you lose the 30%.

In my situation, I think I can get 20-50% DoD, and 60-70% VA depending on what is deemed unfitting. If I hit 30% DoD, I will take the money and run, unless the attorneys are absolutely certain I can get more.

You didn't mention VA ratings, so it is unclear if you are IDES or not. If so, to challenge ratings, you appeal to VA (though, if you demand formal PEB, you can have additional conditions found unfitting, which will raise your percentage assuming at least a 10% rating for these conditions). Depending on how high your VA ratings are, getting a higher military rating may not raise your final total compensation. Need more info to provide more insight.

My PEBLO didn't tell me my VA percentage, but I was told a few weeks ago by a VA rep that it was also 30%. I am married, with no children. I have been an E-4 for almost 21 months. With almost 45 months in service, if my calculations are correct.
 
Your DoD pay will be about $600/month. That will be taxed unless it's combat related; however VA pay will lower how much is taxed even if not combat related. Your VA pay at 30% is $435. You will receive $435/month tax free from the VA and then the other $165(taxed) from DoD which totals the $600. Total monthly after taxes(if not combat related) should be about $570. If this is confusing just remember the final number........$570ish total. If your VA rating or DoD rating is increased at all you will receive more.

Have you talked with an attorney at all?
 
Not yet, I got the call about 11 hours ago while I was asleep after 31 hours of staff duty... Hence while I can't sleep now. I have an appointment at 1030 with my PEBLO today to go over the proposal.
 
Good deal. Go over the proposal, sign nothing until it's reviewed by counsel. Ask her who the Regional PEB attorney is for your base/AO.
