Frustrated at Bragg

As the title suggests I'm at Fort Bragg. Back in 2009 I had a partial chute collapse resulting in a shattered clavicle, and various tears of supporting tissue to include my biceps tendon. Additionally I injured my back at the L4 and L5, and after the surgery repairing my shoulder I got some strange lung issue which has yet to resolve itself and I am now on Asthma medication. I have been through 5 or 6 rounds of Physical Therapy, and bounced from service to service until finally an ortho doc said he was recommending me to be medboarded. That was late fall early winter. At some point in my work up for the MEB with my unit PA she retired and left me uncovered and my case was not transferred. I am just now starting over with a new PA who is unsure of what to do even after telling him I was told by the surgeons office I needed my profile to explicitly state a request for MEB Screening rather than the "pending MEB" it states now, as well as a referral back to ortho for a consult on the MEB. I currently have a T3 as well as a P2, I was sent to an MMRB and found unfit. So many times my MEB should have been initiated and moved forward but has not and I am living a life in limbo.

My question is this: What can I do to get this moved forward, what resources do I have at my disposal to get help, and what if anything should I expect in terms of pushback when trying to do these things. There is nothing I have left out in my description so from the outside it should seem like an open and shut case, and yet through the apathy of the people I've encountered I am being left high and dry. Any help anyone can give me would be appreciate beyond description.

A question for clarification. The four results of an MMRB are: 1) Return to duty, 2) Trial of duty (basically, continue your duties with a profile to see if you recover), 3) Reclass of MOS, or 4) Refer to MEB. If you have had a referral to MEB finding, then they have to initiate it. I would reference AR 600-60. You might bring an excerpt from the regulation and go talk with the PA again. Maybe get some back up in writing/via e-mail form the surgeon's office.

I would start there and see what happens. Feel free to post updates. Best of luck! (BTW, you injuries will be combat related- which means any compensation will be non-taxed and you will likely qualify for CRSC after you get a VA rating).
 
Who told you the profile needs to state "screening for MEB"?

Profiles don't state that. Once you have received a P3 profile and the MMRB refers you to the MEB then your profile shouldn't need changed unless your limitations have changed.

MMRB's are administrative processes that are conducted by your post's G1. Once the MMRB recommends MEB then it falls under the Hospital's PEBLO to initiate and process your MEB and PEB process.

The fastest way to resolve this would be to take the MMRB document stating "refer to MEB" and your permanent profile and talk to the PEBLO supervisor at your base hospital.

That will get you in the MEB process since their was a disconnect between the G1 running the MMRB and the PEBLO office.

PEBLO stands for Physical Evaluation Board Liaision Office.

I just reread your post. You do not qualify for the MEB process.

You have a P2 profile. To qualify for a MEB/PEB one of your PULHES must be 3 or higher.

You also state you have a T3 profile. Until that temporary profile is changed to a Permanent Profile you do not meet the requirements for a MEB.

I don't understand why you were sent to a MMRB with a P2 profile UNLESS your MOS requires a PULHES of 111111 then MMRB would have been required to see if you could stay in Your MOS.

I think that generally, what Daily7777 said was right....but...

How long have you had a T3? After a year, they have to change it to a P3. Technically, regardless of the profile, if you fall beneath retention standards, per AR 40-501, you need an MEB.

Overall, your situation seems to be confusing and it sounds like there are some administrative errors in your case. I might be inclined to think that if the "surgeon's office" said you need an MEB, then you likely either have gone through a MMRB and recommended for an MEB (in which case, you need an MEB), you have been on Temporary profile long enough that you need to be changed to a P3 (and therefore, need an MMRB if you meet retention standards, which it sounds like you had, and were found to need an MEB), and/or you fall below retention standards per AR 40-501, Chapter 3.

This said, it sounds like they have administratively failed to take some action. Need clarification about your situation to provide more insight.
 
It was late when I posted it so I might have been less than clear. I'm a little confused where G1 comes into play here as my MMRB packet went from my PCM to the Division Surgeon's Office and up to the board itself who declared me Refer to MEB. In addition my Ortho surgeon has also referred me to MEB. My P2 was created in order to send my packet to MMRB, my PCM at that time did not give me a P3 because he was concerned it would automatically fail me at the MMRB. I have had a T3 for at least a year. The division surgeon's office told me I need a refer for MEB Screening profile. The thing about the P3 profile is, I shouldn't need it to be referred for an MEB I've been twice referred and I'm still not there because as Jason has suggested they have just failed to take action. I think I do need to go to PEBLO and discuss this with them, maybe they can rouse the people below them into action, at this point I don't care who I have to piss off if it will help get my packet moved forward.
 
***UPDATE***
My PEB case received by MTF date is 1/27/2012. Needless to say this has gone way beyond a reasonable amount of time, It's now March and I have no updates beyond my packet being received. Hopefully in the next month or so I should hear something back. At least that my packet has gone to the VA.

My case came back and I signed it on June 12th. Recieved 20% from the Army and 50% from the VA. I am now awaiting orders as of June 21st.

I signed my DA 199 on June 11th. Tomorrow I get my orders so that should give you an idea that any day you should have your orders.
