So I was referred to the MEB back in October for PTSD and Bipolar 2. I went into the MEB process with an approved retirement request. Me and my treating doctor believe that it would be a quick turnaround and that I would be found P-Fit under the presumption of fitness rule (which I met to the T). However, I found out yesterday that I was found unfit. I'm wonder how does this change the game for me. I'm not too worried about making it to 20 because I still have appeals that I can use on top of the 110 day of leave+ job and house hunting. Is there a chance my retirement pay could be higher by this unfit finding? Any insight would be great.

On a side note. I was approved for SSDI. If your active duty and have an issue that you believe will prevent you from working when you get out. APPLY for SSDI. They back paid me and my children 1 full year.

1. Are you close to 20 good years as a reservist or 20 years active duty which would qualify you for a regular retirement?

2. Assuming you are close to 20 years active duty and will attain that target: If you received a DoD disability retirement, your retired pay would be computed as follows;

From DFAS: All of the retirement plans determine your monthly pay by multiplying your retired pay base by a service percentage:

Retired Pay Base (high three average base pay)
x Service Percent Multiplier
= Gross Retired Pay

3. The multiplier for disability retired pay is either:
  • 2.5 percent for each year of (active duty or active duty equivalent) service, or
  • disability percentage assigned by the service at the time you retire
4. Either way, the multiplier is limited to 75 percent by law. If you are on the Temporary Disability Retired List, the minimum multiplier is 50 percent while on the TDRL.

5. With a disability retirement, your retired pay is reduced by the amount of VA compensation received.

6. CRDP (since you will have 20 yrs AD) will restore the longevity portion of the retired pay. 2.5 percent for each year of (active duty or active duty equivalent) service = longevity multiplier

7. Longevity Multiplier x average high three base pay = CRDP (restored retired pay) CRDP does not restore waived retired that is in excess of the longevity portion.

Thanks for responding. I will have 20 years active duty total. So I am just a little confused. So my r
etired pay is reduced by the amount of VA compensation received, and the CRDP restores that pay. Can you break that down with hypothetical numbers so that I can gain a better understanding. Thanks in advance!

1. If you have 20 years active duty and a VA rating of 50% or more and you receive a regular retirement, then you will receive all your retired pay and al your VA compensation. The amount of CRDP will be shown only as a comment on page two of the DFAS RAS. Most 20-year folks ignore it.

2. If you have 20 years active duty and a VA rating of 50% of more BUT you receive a DoD disability retirement (chapter 61) and your DoD disability percentage is higher than your longevity percentage (multiplier), your retired pay will be more than what you would receive via item one.

3. The scenario in item 2 requires a dollar for dollar waiver/reduction of retired pay, but the CRDP will restore only the longevity portion.

Examples:
A. Item one, 3000 VA compensation; 2000 retired pay results in payable of both in full TOTAL: 5000

B. Item two, 3000 VA compensation, 2900 retired pay at 60% (random numbers); longevity portion of retired pay 2000
This results in:
--2900 retired pay minus 3000 VA compensation = zero retired pay. CRDP restores the longevity portion of retired pay which is 2000
--You would receive: 3000 VA compensation plus zero retired pay plus 2000 CRDP = 5000 TOTAL

This shows only the procedures or formulas..random numbers used.

Thank you for the quick response. How would this determine the ceiling for CRSC? My disability would be combat related. Is there any way around the redux? I thought the chapter 61 was exempt from this. I called everywhere and cannot get a straight answer. I am active duty Navy.

REDUX is not used for a disability retirement; however, if the retiree also qualifies for CRDP and or CRSC, the REDUX ...the redux formula is used for certain elements of the computation.

Hello RonG!
I received a call from my PEBLO that my VA claim has closed. She said that she estimates that i am going to get 30% DoD and 90% from the VA. Why is it that she mentioned that i would be given Retirement benefits but no monetary benefit from my DoD percentage? Is it due to the VA percentage being higher? Any help would be great!!
 
Your retired pay will be reduced by the amount of your VA compensation. From what you posted, it will reduce the retired pay to zero.

Yes, you are correct, but that was an inadequate explanation on her part.
