Found unfit.... So pissed

1. The Physical Evaluation Board (PEB) found CPT America, physically unfit to continue military service for the following PEB referred unfitting conditions:

a. Chronic female pelvic pain, perineocele, pelvic floor dysfunction, s/p hysterectomy for uterine prolapse (fails in combination with Dx 2); Neuromas of the pelvis and pudendal neuralgia with residuals of loss of libido, dyspareunia and vulvodynia (fails in combination with Dx 1) (MEB Dx 1; 2) (V1-No; V3-No; V4-N/A)

b. Status post right shoulder labral repair, rotator cuff repair, biceps reattachment and acromioplasty with residual scars (Right dominant) (MEB Dx 3) (V1-No; V3-No; V4-

No)

c. PTSD from MST (fails in combination with Dx 5, 6); Unspecified depressive disorder

(fails in combination with Dx 4); Panic disorder (fails in combination with Dx 4) (MEB Dx 4; 5; 6) (V1-No; V3-No; V4-No)

2. Soldier’s Component and current duty status as of the date of this memorandum: Regular Army /Active Duty.


3. Please provide a disability rating percentage (with rationale) to this PEB Administration for all referred and claimed conditions.


This is the wording on the memo I received today. I pissed because even after IMR there is no mention of the rectocele and cystocele (hernias of the rectum and bladder through the vaginal wall)... in section a. all of which are a result of the rectocele and cystocele surgeries. I even cussed the IMR doctor. Asking, "Are you telling me that I would have A even had I never had the surgeries?" He had no answer...a$$hole. So a. might get me 10% versus the 40-50% if they were residuals of the rectoceles and cystoceles. What kills me is, I have a letter from the specialist stating that because of the two injuries and their repairs I will no longer be able to lift over 30 lbs for the rest of my life.Yet the VA just doesn't see the connection...GRRR.

FYI.. Im aware of what C. is worth is but its temporary so I am more interested in percentages that I can "plan my future" on...

I do plan on retaining an attorney, if needed, to push the issue. So far my MEB legal guy seems pretty good. He is aware that I am interested in dragging out time to reach the 5 July 15 mark with 90 days leave. But I still want to be assessed fairly and have the DOD and VA rate me fairly.
To be honest I am still in shock that these major injuries and resulting scars, conditions and residuals appear to be completely discounted. Seriously.... How would you feel, as males, about intercourse being painful for the rest of your life because of some jacked up injuries and surgeries and the VA say the two aren't related? That your once great intimate life with your wife came to a dead halt because surgeries have jacked up her stuff so bad.

Any questions, suggestions and/or advice are encouraged.

Wow! I haven't any words to say other than I am deeply saddened to hear about your medical conditions! :(

Upon the receipt of your IPEB findings inclusive of DoD and DoVA proposed ratings, you shall have an additional legal opportunity to have any medical condition reviewed and therefore determined "unfit for duty" by the PEB. Moreover, this strategy also seems supportive of your goal to reach 5 July 2015 with 90 calendar days of accumilated military leave. :)

Nonetheless, never default acceptance to potential injustice; fight then continue to fight some more until receipt of the desired expectation supportive by medical evidence and/or medical documentation. Take care and continue to enjoy life!

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Ok so the VA didn't rate it yet, now as long as you claimed it they are still gonna look at it. If the VA sees it in the same light the geniuses finding you unfit did then that will be a fight after you get the ratings back. Now in retrospect I had a fellow female soldier at my final unit that was scarred for the rest of her life by good ole army surgery. She has a neurogenic bladder and severe white coat fear! So She pulled a hundred percent just for those 2 DOD and VA. So just relax and breathe sister biggest part of this fight is getting the ratings sent the rest of the fight is manageable.

+1 on this. The VA is just now getting it. Also, PTSD does not have to be TDRL - it often is, but it can also be determined to be PDRL depending upon treatment history and response.

Once the VA rates, you have the opportunity for a formal PEB and/or a one time VA reconsideration of ratings, so there is still a lot of game left. Best of luck...Bob
