Initiated MEB with a current VA rating 100% P&T TDIU
injured 2019 AD released 2020 NOV
LOD took about a year to get approved due to bad MRNCO and unit.
PEBLO counseling 12/8/22
C&P exams 01/04/23
MEB found me unfit 04/11/23 they tried saying wasn't service connected even with LOD and VA rating for said condition!
Rebuttal submitted by attorney: MEB/PEB cannot overturn a LOD unless they inquire about said LOD accuracy but NGB is the final authority.
04/13/23 MEB Appellate concurred 3947 corrected to in line of duty
currently waiting on PEB

Thank you it has been a long road I wish you the best as well. If you want a good outcome you have to take charge and learn as much as possible each case is different. As a guardsman, it only adds complexity to the process. In my case, my LOD was vitally important.
 
Thank you. Yeah, I got very lucky that a really good S1 recently fixed my LOD and it got approved after almost 8 years. I have several more to go, but that one is at least a good safety net. I hope you have a great enjoyable retirement. You earned it!

Once you were notified of being Medboarded did they request any documents from you. I am currently at 80% with the VA. I submitted another claim for Spondylitis and then due to the medication im on was referred to the MEB Process. My LOD is from 2009 for lower back and hip pain, but my condition wasn't diagnosed until a few months ago. MTF and VA Medical files will show continued follow up over the last 14 years and mis diagnoses. Do they have access to this and my LOD or will i need a lawyer to do what you did?
