Formal peb in the reserves

I got out of the navy- active duty about 3 years ago after 9/12 years. I then joined the reserves a month after. I was found 100% p/t by the VA. The Navy reserves wants to kick me out. I went through the informal peb for retention- it was not recommend. I now have the option of filing for a formal peb. Is it worth it? I feel like I would get over 30% for my conditions. But, I have to file multiple lod-b and that process seems daunting. I also don’t want my VA rating messed with. Has anyone been in a similar situation. About 12 1/2 years in or so.

So I assume this is non duty related IDES? If so they just kick you out and they don't give you anything.

It’s from active duty time. Prior to joking the reserves. That’s why I don’t know if it’s worth it. The lawyer I spoke to, the jag advice line, essentially said even from active duty time (not reserves) it’s lawful and they have been putting out misinformation then went about citing some bylaws and what not

Ok, here we go. Per the SECNAVINST 1770.5, if your injury is not as a direct result of in-LOD Reserve time, you are not eligible for Reserve LOD, either the LOD-HC or the LOD-B for DES programs.

That *doesn’t* mean you don’t have some service-connected issues. It means you can’t get there through USN RC LOD. You have two options. Forego DOD and go solely through VA….or go through BCNR to try to get back into the DES process as if you were still AD. There are some anecdotal (some might say apocryphal, even) stories about that working. I mean, BCNR solves everything….right?

I have no idea if that will work. But USN RC LOD won’t, because of SECNAV guidance.

BTW….if you are saying that you’ve already gone to MRR, and BUMED recommended NPQ-RNR….the “formal PEB” appeal option is not the PEB you are thinking of. It is not a path to benefits. In this case, in this role, PEB simply upholds or overturns the BUMED finding of NPQ-RNR. If they uphold it, you get separated. If they overturn BUMED, you get retained in service as a Reservist.
