Finally 8mths later Ratings are in...thoughts?

Here's an outline of my PEB/VA findings/ratings. Yesterday at 1630hrs, PEBLO gives me a phone call she was sending me my completed case files and I had 10 days to select one of three choices:
1. Accept TDRL for 6mths @ 50% then re-eval at 6mths
2. "One-time" acceptance of VA rating (VA Rated me at 100%)
3. Go to formal board

I'm sort of confused here, isn't the right answer behind window #2? Does anyone know what "one-time" acceptance of VA rating mean? Can I not go back and have something like my Fibromyaliga reassed? The summary wasn't even close to what the doctor wrote, which would place me at 30-40% for that condition. Thanks for any feedback and best to each of you! TJPoling

what is your rank? and how many year of service so you have. and are any of these combat related?

i have no idea what number 2 is. at first i tought that they we issuing you a 100% VA disability for individual unemployability (IU) because your combined rating should have been 90%. But after looking at your PDF file i am confused. maybe another member can shed some light on the situation.

Dear Tim Poling:

What you have shared on your file is the VA only rating. It does not show what your military branch of service has determined to be "unfit" conditions, nor the corresponding medical issues and percentages for the military "unfit" conditions. So I can't know why your PEBLO is saying "accept TDRL @ 50%...", without giving you the military specifics on that side of your decision equation.

It seems like you will need to have the PEBLO send you both the military and VA findings before you make a decision. By law, you have 10 consecutive days (to include week-ends, holidays) to decide on your options (sign it as OK, request appeal for military, request reconsideration with the VA) once you see the PEBLO that day. The PEBLO is suppossed to give you paper-copy information from both sides - the military and the VA - at that time.

BTW, during this phase you are in, I rec'd a very detailed VA "proposed" rating for 15 medical conditions I submitted. It was more than this one page you have been given (20 pages). It detailed every one of my claimed issues with the VA, and they responded with a multi-page "proposed" rating scheme that broke every injury down by condition, along with the VAs rationale on how they came to arrive at the percentage for each and every one of those conditions.

Have you checked with your VA Rep (the person who initiated your claim to start this VA portion of your IDES) to get a full copy of your VA "proposed" ratings?

You need more than this one page from the VA and you need the military side of this equation as well.

You were not given all of the papers to make a correct and informative decision. Your PEBLO is trying to keep you in the shadows...
 
#2 is supposed to be a one time reconsideration by the VA.
 
Was it 8 months starting from your MEB or when your package was sent to tge PEB?

bman, I was officially notified on 7 Nov 11; sent to the VA Medical Center in DC for the eval on 20 Dec 11; package sent on 22 Dec...so I'm counting from the official notification 7 Nov from my Mental Health Doctor.
 
THANKS everyone for your inputs...nwlivewire thanks for the details. Yes I did receive three different packages but all are from the VA, there is nothing directly from the Air Force as my DOD component. For this posting I only copied this portion not wanting to put all my personal info out.
I have a WORD file that is password protected that I can't open, so maybe that is the DOD side of things. This all went down Friday on the phone at 1630hrs. PEBLO e-mailed me the files and told me of the 10 day reply requirement...the way I'm seeing it, I don't have a complete package, without the DOD/AF portion, so I don't see how 10 days will apply, but we all know how that works out.

Here's my service info:

13 Feb 87 Entered active duty-AF
04 Nov 92 Left active duty - Honorable Discharge DD214
04 Nov 92 Entered Reserve duty - AF
12 Dec 98 Re-entered Active duty - AF
My Reserve duty equaled 1yr-6mths total service time calculated for active duty
23 Jun 93 becomes my new service date-- (Total Actice Federal Military Service Date)

E-7 Master Sergeant paid at 25yrs service; 23 Jun 2012 was 19yrs TAFMSD (Total Actice Federal Military Service Date)

I have sent this all to my AF Wounded Warrior Case manager in San Antionio who will be reviewing it with a JAG I believe.

Also, as my wife and I went over things for about the third time last night, we noticed a SPECIAL MONTHLY COMPENSATION: K-1 Entitled special monthly compensation under 38 U.S.C. 1114, subsection (k) and 38 CFR 3.350(a) on account of loss of use of a creative organ.
I'm thinking this is for replacement of my left large toe joint...dodging 120mm rockets in Iraq, doctors said my adrenalin must have been sky high, I got caught in open field, laid flat for 3-rocket launch, then jumped up and when I pushed off with my left foot I felt something, but for the next five hours, didn't pay attention. x-rays showed the whole joint was blown out.

This would be asking them for a reconsideration of your total package now...at 50/100, I don't think I would choose that option.

LOL I don't think any of us would if we were rated at 100 by DoD!!!
