A little background...I am 20% spinal fusion, 10% right and 10% left lower radiculopathy , and 30% chronic adjustment disorder with depressed mood and anxiety from the VA...total 60%.
Army National Guard with approved LOD for back injury that happened in Iraq, 2006-2007.
First PEB decision was 20% with severance. No offset because of "in combat zone"
Also, have VA reconsideration in for back rating and adjustment disorder rating.
ROM for back has gotten worse and the C+P exam has verbatim 50% rating criteria vocabulary but VA said treatment notes best reflect 30% (which is nonsense).
Appealed and was offered 40% medical retirement (they "offered" the radiculopathy).
I did have a adjustment disorder memo that said was fitting but this was when I was under-rated at 10%.
C+P exams were over a year ago because the VA said they were waiting for a DD-214 and thought I was active duty. To change adjustment disorder to unfitting, the PEB said I have to go to a formal board.
After getting great advice from LTC Parker, a formal board would open the whole thing for re-eval.
So, I have VA consideration in for back and adjustment disorder ratings and a 40% DoD rating pending.
Of course, the VA comp would offset the entire DoD rating, so...
CRSC states combat related....as a national Guard soldier, when we are mobilized....all the training is for combat and then combat itself (I was a medic in a line company) my back started killing me about 7 months into the tour and I sucked it up. No specific incident but because of the weight of the battle rattle and aid bag.
Would like on any insight on how to attack this CRSC thing would be appreciated.
Also, any advice on the adjustment disorder deal is welcome....any advice is welcome.
