Everyone should really read this.

Hey there people,
The last week has been rather stressful for me. I am stationed at Ft. Stewart GA in the Warrior Transition BN. I have spoke with Jason pertaining to this subject and come to find out the things that we had spoken about were completely true.
Heres the thing I dont want others to have to go through the big maze of Bullshit that I have had to deal with.
So it all starts back when they wanted to start my MEB. I went through my Phase 1+2 physicals and began my process. When they were starting my paperwork they convinced me that the condition that I had in my foot was not on thier rating scale and that I was going to be boarded for pain. I didn't care made since to me right to easy no problem. I went through my dictation all the stuff with my foot looked fine but they had recently diagnosed me with Narcolepsy so I had to appeal right off the bat to get that added. They sent me to Behavioral Health, I dont understand this at all due to the fact that narcolepsy is a nuralogical illness not a mental illness. Anyways that was off point just another thing I dont get other that it says to do it in regalations. I had be doing some research for some time and I found Jason and after talking with him and discussing information I had found, we come to the conclusion that the DOD is giving way to many the big hard shaft.
There is a policy out there that states that you can be rated for chronic pain which is good for the lifers that do have pain from running everyday for 20 years. Great for them but the thing is they have slowly began rating people for pain and not the conditon that causes because the pain rating is capped at 20% but the condition that they have may very well be much higher then that.
For example myself. My doctor at Ft. Gordon sent down a list of stuff he wanted put on the board, however none of which were included. I was rated for plantar facisiitis, chronic pain and narcolepsy. Now just focusing on the foot. We are looking at the fact of that I will get 20% for the pain because how the documented it but the plantar facisiitis I will get 10% for and thats it. The problem is my condition is much worse. I can no longer do anything that I use to be able to do as a healthy 21yo. If I'm not carefull I will mess up my previous two surgerys if I sustain to much impact. The funny thing is if they rated for all the stuff that is suppose to be on the board. They would be boarding me for my aquired flat foot 30%. It can't get any lower than 30% that just that that doesn't include the fused bones the permenat facture the elongated tendon the lose of movement and the lose of a tendon in a different part of my foot need for surgery so they transfered it. All of that together would be far more that the 20% cap for pain. Just seems kinda odd that they didn't add it. When I contacted them to find out why they said it was because the pain is what is keeping me from doing my job not the other stuff that causes the pain. Thats when I contacted Jason and he gave me some resources and contrary to what they told me, they must list all boardable conditions on your MEB. And once agian they can not board you for pain as long as there is an underlying boardable condition that causes the pain.
So they sent all my stuff down to the PEB all jacked up knowing that when it got back I was going to nonconcure do to the fact none of that information was on the board. They say percedure I say they try to annoy you enough so you just give up. I am just to bull headed for that HA.

Anyways once they add my narcolepsy with the correct information with the foot I should get far more than just 30% and I better. As of yesterday I no longer have driveing rights. They are taking my DL away from me which I accepted the fact that it is not safe for me to drive because of the daily narcotics and the fact that even with my 4th round of meds I still fall asleep due to my narcolepsy the fact is that in the long run I might kill myself or even worse my family. So I guess thats when I have to stop being selfish and accept the fact. Anyways they are telling me that all of that plus the fact I cant drive anymore and the commanders letter stating that I am unemployable. I should have no problem getting at least 80% from the Army but I am hoping for 100%.

This isn't me asking for help. I just wanted others to know about this policy on pain and to know their rights and how they employ it incorrectly and to protect yourselves and your family.

However if you do know anyone similar I would like to know the out come with the VA and the Army.

I am very interested to see what people think in the poll results. From my point of view, there are many systemic problems that result in Servicemembers in many cases "getting the shaft." The biggest areas of concern that I have are the lack of independent review of cases at the administrative level, lack of legal representation early in the process, high turnover of adjudicators, and lack of institutional expertise in this process. I have had mostly positive experiences with Board members, they are by and large honorable people and strive to do the "right" thing. The breakdown comes from the systemic faults in the system, and the application of certain policies.

By providing Servicemembers with information early in the process, I hope to change the results for everyone who may have otherwise been improperly rated.

Only other thing I would like to add is that by law, physical disability retirement pay is capped at 75%. Since the system awards in increments of 10%, an 80% rating is the best result possible from the point of view of compensation.
 
so is this information true. is what they are telling me, the truth for once. has hell frozen over. what should i be looking for along the % from the VA/Army especially if they take my license away. and if i do get UI how much can i make on the side. i don't think i can continue my live on $2774 a month. well i could but i wouldn't be able to strive for my dreams of a big home and a better life for my family like I had in the past. someone help me find answers please.
 
If you do get IU (Individual Unemployability) then you will not be able to work. The VA will cross check with the IRS to see if you have earned any money. You should be hoping for Permanent and Total because you can still work with that rating.

Jason has the regulations about working while IU here. I have a feeling there is an actual dollar amount that you can earn on top of your IU each year and still not be considered gainfully employed. The regulation also mentions being employed for 12 consecutive months, so if you can find seasonal work where you only work a few months out of the year, that might work too.

VBN is a great site that has a lot of specifics about VA claims and an entire section dedicated to being IU. If you hop over there you may find answers to questions you didn't even think to ask.

Do your dreams include living in a specific area or state? In some places the housing market is still amazingly affordable, and the usual stigma of areas like that having a poor job market could very well be made up by your DOD/VA compensation.

I am and will without exception move back to Indiana. My family and I are far too family oriented considering my daughter just turned 1 there are no exceptions to the wifey and family they went along with my endevors now its time for me to play their game.
The whole IU thing was because if that occurs I would like to go back to wood working here and there and selling things but I also want to have the time to volenteer to help with DVETS that are comeing back my way to make sure they are not getting the shaft like they are trying to me.
The best defense is a great offense. They need to know the facts and thier rights. And I plan on makeing sure they do.

Here is a simple financial spreadsheet for Excel. It's basic, and I'm working on some improvements, but it really gives a great visual to show where your money is going.

Also, that's great with wanting to volunteer. It's always nice to hear someone who wants to give some of their time to help others.

I gather that being IU means you cannot be substantially gainfully employed. That's what I got out of the regulation Jason provided. What I'd really like to know if there's a dollar amount that defines "substantially gainfully employed".

I have this sneaking suspicion that I'm confusing myself though. I hope I'm not. It would be horrible to think you could get punished on IU while you work a few hours a couple days a week helping out your church or the YMCA or something with admin stuff and they pay you for it. :eek:
 
there is a certain amount that you are allowed to make i am not sure as to how much but like i have always believed it only applys to the amounts you are recieveing a w-2 for.
 
The bad thing I could see about working for a small, taxable amount while IU would be that you could wind up spending more than you make just getting to work.

A couple hundred extra a month might sound good at first, but once you add in the price of gas to get to work, the cost of work clothes, the cost of food if you go out to eat at lunch while at work, you could find yourself spending more money than you're making.
 
I'm not pushing for IU. I'm just curious what you could earn while IU. As DamangedGoods had pointed out, Permanent and Total Disability is the better option, since you would still be able to work, and also for medical benefits for the family, and that's the one I would try for.
 
that comes down to manageing your money. some people say that being in the military they never teach you how to do that but i have learned very well i support 3 people on a small income of 2500 a month and im still able to a new car to drive well that was till they took my license so i guess for my wife to drive.
