Estimate for DOD rating

I was referred to the PEB and found unfit for

1. A labral tear s/p surgical repair in my right shoulder (dominant)
2. A moderately severe ulnar neuropathy at my left elbow (non dominant)

I was wondering if anyone has an idea what percentage i might receive as far as the DOD goes, or what i should expect and maybe not take less than.

I've looked at the ratings for the VA but I know DOD is different. Thanks.

DOD is not different. They must use the VA ratings for your unfitting injuries. Percentages will come down to your C&P results, and where they fall on the rating scale on the VASRD.

Ah! I thought DOD did their own rating and thats why people would end up with like 10% DOD and 60 VA or something. From what I understand the VA rates all conditions and the DOD just does the unfitting ones correct?

Everything identified during the C&P exams will be rated. They will be listed on your NARSUM as DX's. After each DX there should be a statement that reads "fails to meet retention standards" or "Meets retention standards". This goes up to the PEB board and they will find you "fit" or "unfit" for each DX. They usually follow the MEB and find you unfit for the conditions that the MEB wrote "fails to meet rentention standards". There are times that they may do their own thing, or you appeal and they will add or subtract an unfitting, or fitting condition. Once they are done, they send everything to the VA. The VA rates all DX's and then sends it back to the PEB. The PEB then generates a DA 199 (Army), or whatever you service equiv is and sends it back down. DOD only applies the VA ratings to conditions that were found "unfit". The VA applies ratings to the rest of the fit conditions. This is why you get the two separate ratings. For example:

You have 20 conditions claimed during your C&P exams. 2 of the conditions are deemed unfitting and 18 are deemed fitting. DOD would apply the VA rating to the 2 unfitting conditions, and then use the VA provided ratings to come up with your combined DOD rating. These will be the only conditions used to determine whether you are below 30% (severance) or above 30% (retirement). The VA will combine all conditions (including DOD) and give you your VA rating. This is why the two numbers are different.

WAIT A SECOND!! Are you saying...if I understood correct..example: VA says 40% for back injury (unfitting condition) does that also mean 40% for the DOD side of ratings? If so does that mean "medically retired?"

Yes if you are rated by the VA for DDD and DOD listed it as an unfitting condition, that is exactly what it would mean. And yes, that would be medical retirement.
