Enlist Help from DAV

In trying to beat the DOD to the punch and better control the findings of a C&P physical, I understand that I can meet with the DAV to file claims while on active duty. I plan to file for term of service retirement in October for November 1 2014 but wish to avoud the MEB machine in the time remaining.

Would it be wise to seek help from the DAV as an advocate in order to ensure correct rating and treatment of claims to be filed with VA/DOD?

I believe this is what was just explained to me by a member of my local VFW.

Any and all support on this matter is greatly appreciated.

Sure it wouldn't hurt anything, you are to make your claims when you separate anyways! It just gets the waiting to get the rights to review your records out of the way, which takes about 30 or so days. They will even help you with listing out your claims ahead of time.

Thank you. The "Ahead of time" and good guidance is what I am interested in. I want to be very careful though not to do anything that may result in a MED process between now and November 2014.

I Plan to apply for retirement next month for the following November 1 2014. 60 days Terminal Leave in September 2014.

Once I have applied and been accepted for retirement can they still try to MEB me. My plan was to ensure all remaining Doctor visits and records are turned in by January after apllying for retirement and scheduling my C&P for April wich should allow 3 months for my medical records to be updated I for me to get a copy.

To make things worse. Our unit is loosing (RIF) 16 of 18 members. I of course am in Sanctuary but my CC wants to deploy me to the sandbox with 19 years and 9 months TAFMS. They are aware of some medical issues but not the ones I suspect would be found unfit.

Quite a little trick box I am stepping through here.

Any guidance on my timeline for a successful 20 year retirement plus concurrent receipt for VA?

With them wanting to deploy you they may catch it through the pre-deployment screening process. That may start the MEB right there, but that is IF they catch it. But even still if they start the MEB in oh say Nov/Dec this year you have a high chance of hitting your 20 anyways. From what I am gathering you are pushing to be able to collect CDRP, correct?

Yes Sir, that is exactly correct. Not to mention the slim chance that none of this is perfect and a silly 20% severance could be forced upon me though unlikely.

In addition my doctor just increased (1) medication due to the fact that (1) condition has worsened. Would the military want to wait for the problem to stabilize/worsen/improve (6 month period) before starting a MEB or is that too much to hope for? in fact I have learned in the last 2 weeks that 2 conditions have worsened to what should be 60% each under the eCFR. Then there is the entire DDD/protrussions and Buldge issue. etc...

I plan to turn everything in by January anyway. I am just kind of dragging my feet at this point as if it were a MEB as I understand that it is important to take all the time one can especially in the beginning of the process. I have a appointment with a Neurosergeon for my back at the end of October and a Sleep Study scheduled for late November. Plan on attempting to get my retirement papers blessed at the end of October/first of November.

I must also ask again, if I have approved retirement papers will the military likely start a MEB anyway?

Really just hoping that my retirement gets approved, I can make appointments for TAP and C&P then turn in updated medical information from my civilian PCM to the MTF to have entered in my records for VA.

None the less I believe I could appeal, appeal, stall, drag and appeal to hit 20 TAFMS.

The question if they will start a MEB while you have retirement papers in is a good question. In my opinion they most likely can and will try, though someone may give you better insight than I will ever be able to. I just wanted to get some questions they would ask out of the way.

I agree, it is unlikely that an MEB would get started and finished in time to keep me from reaching 20 TAFMS. My anxiety gets the best of me and I dwell on the negative. I just need to shut my mouth and do my job the best I can every day for one last year.
