DOD/VA %'s are IN

I asked that question before and ppl said it's difficult to prove. It was actual unit mission training that involved other agencies. Our unit is kind of unique, we get paid hazard duty pay for our mission here state side. So I guess I would need to know what's needed.

See DoDI 1332.38 for what qualifies for combat related.

In addition, please reference the below attachment to view an explanation of disabilities designated as combat-related...

Thus, I quite often comment that "possessing well-informed knowledge is truly a powerful equalizer."

Bear in mind the document posted by warrior is the position of the USAPDA for use by Army PEBs. Service CRSC offices and other service PEB offices may have variations in their definitions and examples of combat related. If in doubt, apply for CRSC.

The criteria is as follows:

Disabilities that may be considered combat related include injuries incurred as a direct result of:
  • Armed Conflict
  • Hazardous Duty
  • An Instrumentality of War
  • Simulated War

In my opinion, you should try to re-account the particular mission that you were on when the injury took place.

Once you have created the narrative, see what supporting documents you can provide such as operation orders, fragmentation orders, memorandums of record from others who participated and of course medical records.

Once you have this, complete a DD2860 http://www.naus.org/documents/DD2860.pdf

Prior to submittal, have it reviews by a knowledgable VSO or mentor that has successfully applied for and was awarded CRSC.

Roger, Thank you all. I will pull my orders for that training and I may even have the OPORD that gives the whole mission. I will submit and see what they say, who knows I may be eligible.

Thanks for the clarification of facts with combat-related determinations in use by different military organizations/agencies! ;)

ARMYLOD,

I disagree completely of what your MEB/PEB Attorney told you what to do about TDIU. If you feel that you cant work, have medical conditions and VA ratings that you need to receive TDIU such as one rating at least 70% rating and or 60,40,30 rule. Make sure on the VA Form there is a box that you need to ask for scheduler and extra scheduler rating. If you don't qualify for scheduler they will send your request to the Compensation Manger to decide if you can receive extra scheduler rating. It's vey important to do that. There's VSO's about 98% that doesn't tell anyone to do that. Don't let the VA figure out what you want you need to tell them what you like to have. VA Duty to Assist is a joke in my eyes. If you apply for TDIU I have a lawyer that wrote a Ebook on TDIU I could forward you to him.
Thanks
