My husband was injured in Afghanistan 2009, was thrown after a blast, hit head and injured knee. Put in WTU for injured knee, had operations and complications, but during recovery I became concerned on his mental state. Evaluated and diagnosed PTSD by private physician WTU refused to treat/help with this diagnosis, said they only had to take care of knee. Released from AD 7/19/2012, back to Reserves. We pursued VA claim on our own. (He could not work this whole time). Finally got 80% rating in 2014 with beginning date of July 20 2012. Eventually, he received 100% IU, combat related. Signed with a Psy/Ops unit for drills, but eventually had to stop because of PTSD, gave unit Doctors orders that he shouldn't drill, but they still sent counseling statements. Unit of no help whatsoever regarding INCAP pay or pursuing retirement based on disability.
Went through IDES and found unfit for duty, retirement coming up.
I believe he should have never been released from active duty and/or should have been receiving INCAP pay, since he has not worked since being released from AD.
Would they retro payments? What are our options, if any
