CRSC Timeline

Since I haven't seen anybody do this, I will go ahead and post my CRSC information. Maybe it will help others figure out this big, confusing process.

First let me give you the basics. I am Army, I was retired for my back at a combined rating of 30%. I was also rated by the VA for adjustment disorder-30%, Cervical Strain- 20%, DDD-20% Ankle Strain- 10% and Radiculopathy-10%. My combined VA rating is 70%

Of these conditions, I claimed the following as combat related and hazardous service related because of my 9 years flying.

Adjustment Disorder- 30%- I linked my depression and anxiety to flight duties under hazardous Service. I provided my flight records and my 199 as evidence.

Cervical Strain- 20%-I linked my cervical strain to flight duties under hazardous service. I provided my flight records and my 199 as evidence.

DDD- 20%- I linked this to combat. I used records of my aircraft accident, 199 and flight records as evidence. My 199 is combat rated for this condition.

Radiculopathy - 10%- I linked this to combat. I used records of my aircraft accident, 199 and flight records as evidence. My 199 is combat rated for this condition.

I did not claim my ankle because it happened in garrison while doing PT. My combined rating that I claimed on DD 2860 was 60%. According to the VA compensation charts, if all 605 is approved, it will restore $1169 of my retirement pay.

I plan to file mine after ETS. I am gather supporting documents, to include sworn statements from then Company XO, now MAJ/O-4

My ETS was 25 Jun 12. This is the day the VA approved my final ratings and mailed them to me. Up until they do this, you only have proposed ratings.

Good luck and please make sure you post up your timeline. CRSC is one of the most misunderstood benefits around and all the actual data we can provide will help all.

What kind of aircraft? Were you flying combat or combat support? What caused the accident? Disabilities caused by cumulative wear and tear are not normally approved for CRSC.
 
It was a blackhawk and every mission we flew in Iraq was a combat mission. The flight hours are listed as "combat" in my records. A lot were air assualts, but even with log, or support flights, they are combat. I can't count how many times we did log pack missions and had assualts, or other specific follow ons added. In addition, if you read the Hazardous Service definition on the DD 2860, it says:

"Such service includes, but is not limited to, aerial flight, parachute duty, demolition duty, experimental stress duty, and diving duty. A finding that the disability is the result of such hazardous service requires that the disability be the direct result of actions taken in the performance of such service. Travel to or from such service, or actions incidental to normal duty status not considered hazardous and are not included."

By their definition, my 1500 flight hours would be considered harazdous service. Everything in garrision is training for combat. In combat, every flight is listed as a combat mission on the brief sheet, risk assessment and posted in your perm records as combat hours.

I will be very surprised if they deny that portion. The challenge I see is getting my adjustment disorder approved.
 
Ask how many people here have had their CRSC claims denied for cumulative parachuting injuries. I'm not saying your claim won't be approved. I just wouldn't count on it.
 
We will see what happens. I am not saying they will deny, but feel I have a pretty good leg to stand on if I were to appeal. I am basing everything I know on the form, and the DOD CRSC program guidance. If they say no, I will appeal. Not a big deal as I don't count this money as income I need, it would just be nice.

On another note, it may not matter. The house and senate have reconcilled the NDAA 2013 and have included the adjustments to concurrent receipt for chapter 61 retirees. Here is the MOAA article.

You have to appeal at least once to the CRSC Branch. If they deny your appeal, they will tell you that if you want to pursue it further to complete a DD Form 149 and send it to the BCMR. I'm just telling you what I would be looking for if I was writing your case for the BCMR.
 
Totally understood. We will see where it goes. I should have my notification within a few days according to my call to the CRSC department at HQ. It would be nice to see it before Christams, but I won't hold my breath.

What is it that you do? Are you a lawyer, or how do you know so much about these claims. You seem to be very knowledgable.
 
No, not a lawyer. I was an ABCMR Team Chief. When CRSC was first enacted the ABCMR wanted consistancy in its rulings. In order to do that they decided that they would only have one analyst write the cases. That person was me. They now give CRSC cases to all analysts. But they still use my library in doing so.
 
UPDATE: Received decision letter today. For the most part, it is great news. I applied for 60% worth of conditions and they awarded 50%. The only thing they denied was my cervical strain because that was not documented well enough to be considered. I will probably file that one again and add some paperwork.

What the did approve was:

Adjustment Disorder - 30% - Based on Armed Conflict
Degenerative Disk Disease (DDD) - 20% - Based on Hazardous Service
Right Lower Radiculapothy - 10% - Based Instrumentality of War

Total Combined Rating of 50%

If you read above you will see what I based my claim on. Another point I would like to stress is I kept things clear and concise. I did not send a 3 inch thick stack of medical records to them to dig through. I started with clearly stating my rational for each injury on the DD 2860. I then attached minimal documentation to support them. All they car about is the "how" you are tying it to combat, or one of the other categories.

Anyway, very excited! Now I just have to figure out how long it will take DFAS to pay me. Here is my updated timeline.

CONGRATS!!! Did you wait to file once you received your first disability payment?
 
I applied after I got my ratings in the mail. I still hadn't been paid yet.

Now the next big thing to figure out is going to be how to get my back pay. I see it as being very interesting. Since my VA ratings took 4 months to complete, DOD was paying me. When my ratings were final and I collected my first payment, it was Dec 1st. The VA pay ends up being more than my DOD pay by 80 bucks, so they back paid me for the difference. This is where the confusion will begin.

CRSC is piad by DFAS and is back dated to discharge. It restores some lost retirement pay, but I got retirement pay for Aug, Sep, Oct and Nov. The VA kicked in and took over on 1 Dec. If CRSC is backdated, who is going to pay the $931 per month I was not getting while the VA was finishing my ratings? The VA also backdates to the discharge date, but only back paid me for the 80 bucks per month I lost while I was getting DOD pay. So??

Who do I try and get the $931 from? DOD is going to say we paid you retirement pay for those months. The VA is going to say they back paid me for the difference between what the VA would have paid me above my retired pay. I have a feeling this will shape up to be an epic goat screw but who knows. I could just let it go, but I would be letting $3700 dollars go.

Anybody with some experience with this, please chime in.
 
very interesting, and confusing. Could I file once I'm out of the military? I have everything ready except a sworn statement from old Battery 1SG. Also, did VA back pay you the 4 months? Just curious what is going to happen and I want to prepare my family. I like to "think worse case" and anything short of that will just be positive lol
 
You have to wait to file until you are out of the military and in possession of final ratings from the VA. Where most people get confused is thinking the ratings you get when you sign your 199 are your approved VA ratings. They are not, they are proposed ratings. The VA will not finalize your ratings for one month to a few months after you finish terminal leave and are officially discharged.

So to answer your question, yes you can file once you get out of the military, but not until you have final ratings from the VA.

No I have not received back pay yet. I haven't received my first CRSC check either. I am assuming it will all come together around the first of Feb. I also think it will take a few months to get the back pay fixed.

where is this calculator? every time I go to this one site, it just shows a blank page. (I have Firefox and Opera)
