CRSC & TDRL

I’m hoping someone more knowledgeable than I can answer this question. Situation is as follows:
- Medically retired
- TIS: 14 yrs 4 months
- DoD 70% VA: 100% P&T
- CRSC awarded at 90%

individual receives notification of their 18 month TDRL are-evaluation for unfitting condition that was rated at 70% by DoD.
Question:
If individual has a decreased rating as a result from the 18 month re-evaluation for TDRL such as 70% to now 50% or 30% or even worse lower than that and under the retirement threshold; what happens to CRSC? As I understand it, the VA rating would not be affected by this evaluation as it is considered P&T and separate from this DoD evaluation. What I can’t figure out is if CRSC is tied to DoD rating or not and how, if at all, that it would be affected by a possible reduced rating following 18 month re-evaluation. Thank you!

1. CRSC is tied to the amount of retired pay in that it replaces some or all of the retired pay waived/reduced/offset by the amount of VA compensation.
2. If your DoD percentage decreases, in most CH 61 cases, the amount of maximum CRSC payable decreases.
3. Some facts about CRSC:
--Can never be more than the longevity portion of retired pay
--Cannot exceed the dollar amount waived/reduced/offset by VA compensation
--CRSC when combined with residual retired pay (left over from the waiver) cannot exceed the longevity portion of retired pay
--CRSC cannot be more than the CRSC percentage amount which is found in the VA compensation tables.

Thank you for your reply. I'm hoping with some better figures you can help me determine if my CRSC will change based on whether my DoD percent is reduced during my upcoming evaluation. If I am understanding things correctly it won't but I would like a sanity check.

1.--Average high three for basic pay: Gross retired amount on DFAS RAS is 2967.00. My high 3 is 4239.00
2.--DoD disability percentage: 70%
3. --Active duty years and months: 15.333
4. --VA compensation: 3873.5 (Spouse, 4c under 18, SMC-K @ 111.74)
5.--Projected or approved CRSC percentage by your service: 90%
6.--Whether you qualify for another type of retirement and whether you transitioned to the blended retirement system: No
7.--Did you receive a REDUX/CSB payment? No
8.--Did you accept the Blended Retirement program option? No

My current CRSC amount is 1625.

My question is would it decrease if I am reduced to 50% or 30% after my upcoming TDRL 18-month evaluation. Also, if they do decrease my DoD rating for my unfitting condition from 70 to 50 or 30 will that affect my VA rating for that same condition since my VA is P&T.

1. Your retirement pay will be reduced. That will cause the amount of waived retired pay to decrease as well. That in turn causes the CRSC to be a lesser amount.

2. On the other hand, the lowest possible multiplier for your retired pay will be 15.333 x 2.5% = longevity multiplier
If the DOD percentage is higher than the longevity multiplier, it will be used for your retirement pay.

3. I will look at this again in the morning...likely before 0900 hrs central time zone.

Comments.

A. Gross on RAS 2967 divided by 70% DoD = 4239 (rounded) high three
B. 2967 gross minus 3873.50 VA amount = zero retired pay remaining
C. AD 15.333 x 2.5% = 38.33% longevity multiplier
D. 4239 x 38.33% = 1625 (rounded) longevity portion of retired pay AND current CRSC (which means the longevity is less than the 90% CRSC amount initially approved)
E. If DoD was reduced to 50% = 2120 gross retired pay, reduced to zero by VA amount. Your CRSC would still be 1635 if the CRSC percentage remains at 90%.
F. If DoD was reduced to 30%, then the longevity percentage would be used instead and it would be the amount shown at item D. That results in the same CRSC amount if the 90% approval remains intact. The CRSC and the longevity are both the total waiver of retired pay in this scenario.
G. Since the approval of CRSC is based on the VA ratings (the combat-related disabilities), I don't think another CRSC application is necessary.
H. Without running the numbers earlier, it appeared at first glance that your CRSC might decrease significantly. However, the 30% vs. 38.33% longevity percentage results in a happy ending...
