CRSC claim same as unfit condition for PEB

Can your CRSC claim be the same as PEB? I understand the max offset based upon DoD disability and longevity pay. In my case it is my back and neck related to a combat injury. I will be getting a medical retirement of estimated 60%. If no other conditions are qualifying for CRSC except the same ones that were used for the unfitting conditions would my CRSC retire my retired pay at 60%?

The CRSC % is based on VA percentage. So if 60% VA pays $1,214.03 for a single soldier then that is what your CRSC amount would be assuming you don't hit any of the other limits due to longevity etc.

As you mentioned, your CRSC cannot exceed the longevity potion of retired pay.

The Years of Service for Retired Pay Percentage Multipler. YOS for retirement percentage multiple determines the years of service for computing the retired pay multiplier. This category of years of service includes all periods of active service (counted as one point for each day) plus all points earned through qualifying reserve duty, not exceeding annual limits, divided by 360. Common jargon: “active duty equivalent“.

100% VA = $3746
Longevity equivalent = $4597
I would get paid $2484 + $3746
CRSC would restore up to the longevity pay of $4597 (I don’t expect the max) + 100% VA disability?
Trying to understand everything. I anticipate 60-70% CRSC.

2. 6230 minus 3746 = 2484 residual retired pay (you keep)

4. Using your longevity computation, 4597 minus 2484 = 2113 max crsc
5. Using your figures, DFAS would pay:
—2484 residual
—2113 CRSC
TOTAL: 4597
6. VA pays 3746

If the approved CRSC percentage results in less than the longevity, then the amount shown in the VA comp tables would be used and the combination of that CRSC amount and residual retired pay cannot exceed the longevity amount.

Also, your conditions are NOT limited to what the PEB finds you unfit - it's any service-connected conditions that MAY be approved by the respective service branch to determine if one or more conditions are combat-related. So don't limit yourself to your DoD conditions, look at what the VA has rated you for. For example, Tinnitus is not an unfitting condition, but it can (and pretty much usually is) considered combat-related, typically due to "Instrumentality of War"

I will apply for anything that can have a link but I estimate 70% CRSC at the most. The other things are all going to 10%. But I am still awaiting my VA percentages. I only recent received my NARSUM and had my lawyer estimate me at 60% DoD and 100% VA.

Longevity for me will be based on points. I estimate 7,000 points but it depends on when my 199 is read and if I do a formal appeal request.
