hello all, I've been successful reaching Al at the Army office but he has only been able to tell me that the Army has my file and it's pending. That was 4 months ago and he got frustrated with me when I spoke with him about a week ago and he won't inquire again as to where my file is. Anyone have a phone number to the other offices that process our files before Al?

Here's my timeline so far:

Submitted to PDBR in June 2014, all files collected in August 2014. Case adjudicated December 2015, sent to the Army February 2016.

I was discharged for panic disorder August 2007 after 2 tours in Iraq. I was an E-5, 19D Cavalry Scout. I got 10% severance. VA diagnosed me with PTSD and other issues like hearing loss but PTSD alone at 70%. I'm now 100% PTSD and have been since 2010. I never repaid severance because they did not rate me for panic disorder. I got $13,500 or so from the Army. I would assume that if I win my pdbr I would qualify for CRSC as my only extra cash to earn in back pay? Less severance of course.

My pdbr case is 2014-029XX.

All of us rave about how nice Al is. Perhaps he was having a bad Monday and you can try him again later in the week? I am not aware of a contact prior to Al unfortunately.

More than likely you'll get something minus that severance. I was discharged from the navy in 2008 after four surgeries, and received 20%. I was initially rated 60% VA and for $20,445 in pay all of which I had to pay back over time. I'm not 90% VA and have had two more surgeries. I submitted my claim to the PDBR the same month as you and the same year however I have heard nothing except that my case is in adjudication as of January this year. If you are awarded anything I would expect them to take that 13,500 from your retirement back pay. Honestly I'm glad I got it over with so they wont touch mine. I have heard that under certain circumstances, the severance doesn't need to be recouped. I'm guessing you'll just have to wait and see.

I didn't get mine back. How do we go about doing that?
 
I wasn't aware of a deadline, but from what I just read this is what needs to happen to receive the taxes back.

"Due to limits of the current Defense Finance and Accounting (DFAS) pay system, taxes will be withheld on active duty cases separating with severance pay. Procedures exist for the local servicing finance office to coordinate with DFAS-Indianapolis for refund of the taxes withheld. The request and required documentation must be received at DFAS by 31 December of the year in which the severance payment was received. In the alternative, the Soldier may seek a refund when filing their tax return. For more information on filing with the IRS contact the Servicing Finance Officer or USAPDA."

There maybe more info, but I couldn't find my original documents so I went on google and found this info..
 
The deadline is only if you will get your money back directly from DFAS. After December 31 final financial and tax information is sent to the IRS to be compared with your tax returns. So they cannot refund you after that or it will throw your IRS file off. So after the year ends you must file an amended return with the IRS. So you must go back and re-file taxes for those years in which you repaid your severance. It'll take a few months but some have paid thousands so it would be worth it.
 
I spoke with Al yesterday and he still doesn't have my file. The Army has had it since March of this year. How much longer do I have to wait to hear anything???
 
They had mine for 6 months before it was done. You're right about there now. Hopefully it will be this month!
 
I got a letter from the Army. I was screwed as they agreed to a 50% TDRL but revert back to my 10% permanent after the 6 months from date of discharge as they only had my initial C&P from the VA at 3 months and nothing at 6 months so they are saying that my condition was stable and warranted a return to 10% where the VA had awarded me 50% for my PTSD and then my conditions got worse where I eventually got an increase to 100%. Can I appeal to a higher authority here? I mean they agreed I should have been 50% but how they thought I was ok at 6 months when my 3 month from the VA showed 50%???
 
There definitely is no standard in these PDBR reviews!

My condition is PTSD, but they still label it as bi-polar but whatever, and I didn't have a C&P exam for nearly two years after discharge. But I was given 50% PDRL.

I don't know about an appeal as it says the decision is final. Could you do a BCMR and make an attempt that way?

I am not sure if I can go back to a BCMR or not. Any feedback is appreciated.

Did you ever file an appeal? There is legal precedence set in a 2016 federal case where a federal judge ordered the Us Army PDA to permanently retire a veteran because the army never placed the veteran on tdrl as required by 38 cfr 4.129. mental disorders. The judge told the army that going back in time and constructively doing a tdrl without a actual board was illegal and didn't afford the veteran due process. When the pdbr used your VA exam at 3 months they should have legally conducted a PEB board based off of the VA exam if they wanted to use the results for a pdbr recommendation. The veteran was awarded a 50% pdrl. It's federal case Ronald c. Cooke v. The united States. Respond to me if you get this scout.
