Confused about pay

If i go onto TDRL with 30% rating, how much retirement pay will i receive? i am confused because i read somewhere that i can not get less than 50% while on TDRL (i have less than 20 years in. 4 to be exact). so can someone please explain how to calculate what i would be entitled to?
 
The minimum payment on TDRL is 50% of your retired base pay. The percentage awarded is your degree of disability, but the law gives a minimum amount paid for those on TDRL. While on TDRL, your condition must stabilize in order to change the percentage. So, for example, if you go on TDRL with a 40% rating, you are still paid 50%. At the first re-eval, say, you are then at the 30% level of disability, but still unstable, you continue to receive 50%.

okay, i know this is probably posted somewhere, but can you please tell me how to calculate that 50% or is that 50% the same as the VAs 50%?
 
Military compensation is calculated differently from the VA (which is based on a schedule that applies to everyone equally regardless of time in service or rank). The military percentage is applied to your retired base pay (which is the average of the highest 36 months of active duty base pay).
 
okay, so for the next 5 yrs i'd get 50% of the average of the highest 36 mths. would i also be getting the 30% from the VA also?

if you were rated 30%, you would get 50% of the averaged high 3 years for the time you spend on TDRL. THIS IS IMPORTANT....You may not stay on TDRL for all 5 years. Remember that members put on TDRL are re-evaluated every 15-18 months NOT to exceed 5 years. If your condition stabilizes then your status will change. (Severance, PDRL, or return to duty) So say that you stabilize during your first 15-18 months (noted through medical documention), then most likely the board will take you off TDRL and transfer you to the appropriate status. TDRL is meant to give appropriate time for unstable conditions to become stable. Some people go back to active duty, some people are separated with compensation, some go on PDRL and then others who have not stabilized remain on the TDRL and await the next re-evaluation.

For the VA to rate you, you must go through your compensation and pension exam. They will thoroughly evaluate your claims and come up with their own ratings-unless you are part of the pilot program-and then I believe the claim is concurrent with your PEB.

Oh, another IMPORTANT point.....as of right now, since you were only in for 4, you would not recieve both VA and Retirement (thats for those who made 20yrs). There is an offset. VA money is not taxable. Retirement is retirement and therefore taxable. I'm not the guru and I don't want to mess this up...but what I do know is that those who get VA money tend to take that full check (not taxable) and then they usually get some portion of their retirement (the amount is reduced by the amount of VA money you get). You can't get both. Not until the law changes.

If the VA determines you are eligible (it should), then, yes.

Now does this mean, if I get 30% Disability(from the army, with 6 years in) and 30% from the VA.. I'd only get one paycheck? or would I get both from the army and VA?
 
so what happens after the five years if you do not stabilize out? would they just put you back on TDRL or make it permanent. I am getting 90% and paid at 100 and was told by the doctors from the VA and social security that i would never work again. All the docs say i am getting worse so what happens then? would it be permanent? But yes on the pay you either get whichever is higher either the va or military you cant really choose
