Close to 120 days... Need help

Initial Diagnosis: March 2013 Celiac Disease w/ digestive complications
May 2013 : Referred to MEB
June 18: Narsum signed, 7 conditions. 1 unfit (celiac)
June 26 : Unfit Memo Issued by PEB
Oct 15: Still waiting for Ratings...

I was told the VA had 120 days to issue ratings...well.. in 10 days it will officially be the 120 days mark.

I know my packet is in Seattle but my ebenefits still says " review of evidence".

My PEBLO, if i can get a hold of him just says, " yea we havent heard anything, we will call you when we find out" .

Starting to get frustrated!! Any advice?

The 120 days is a guideline, not a set amount of time they have. It is 120 days +/- 2 months a couple of months depending on how complex your case is, and that is not even a sure thing. You also need to factor in a government shutdown which will add time. No the VA has not furloughed all raters, but there are effects from other areas of the VA.

I am sorry for your frustration, but don't get it set in your head that there are any strict timelines during this process. Your packet is in a sea of thousands in your same situation. Take this time to work on your transition plan and get ready for life after the military. The good news is you are getting paid full salary during this process vs a already discharged vet who has no pay and waits an average of two years for benefits.

Good Luck,

Joe

I understand. The IDES is the ultimate of patience. It's been 181 days since I signed my narsum and case submitted to the PEB. My case is moving though. Got word that VA is done with my ratings and have been sent to the PEB. My ebenefits still says "Review of Evidence". I think a bottle just wasnt hit on mine because of all the correction that my claim need. You will probably see some movement somewhere between NOV-JAN. Get a DAV Rep; that may help with some info for you. But hey, we're in this together. You are not alone bro.

If it makes you feel any better my packet was sent up for ratings on Jan 25th (264 days ago) was opened up and sent right back to the PEBLO the very next day.

This is what my Ebenefits site looks like. I know this thing is grossly inaccurate but is this what it should look like when you haven't received proposed ratings yet?

It means the VA has finished the prelim ratings and is waiting on the DD214 from the DoD, you should be getting notified shortly of them. They did in fact do the wrong thing by closing the prelim claim and starting the final ratings process early, but they are going to assume you will be very happy with your ratings.

Brother mine started last year june 6 and ended in july of this year!

So on ebenefits my case showed it was Pending Decision Approval, then got kicked back to gathering more evidence, and they want me to send/upload my DD 214. I am still active duty! Does anyone know what this is about? I have been waiting for my rating for 114 days.

Means your rating are proposed and sent to PEB, now your just waiting for 199

It means your proposed ratings are done and they have sent the results to the PEB. The waiting for the DD 214 is because your MSC will send that to them after you final out. When you become a veteran they will then take your proposed ratings, and the DD 214 the MSC provided to finalize your ratings, and start paying compensation. This will take a few months after all your terminal leave is up, and you are officially out. In the meantime, the PEB will have everything they need to adjudicate your case.

Bobby0081 - Outstanding!!
10Sep13 Unfit sent to VA DRAS
27Oct13 Ebenefits status changed and claim was moved to historical and new claim opened.
29Oct13 Ebenefits status changed to "PREPARATION FOR DECISION"

But, ???
Sum ting wong. My Unfit was sent to DRAS on 9 July - 2 months before Bobby's. I don't even know how to pose the question. Every day I'm a little more numb.
Life awaits me, just out of reach. I can see it out the window of my cell, hear it call my name, but the VA chains are holding me tight in my cell.
Those of us still waiting, we are like the Ultimate Mushrooms.

You may be a little confused, the new claim that was "received" on 9/10/13 it states under Claim Type is "Compensation" this means the VA's preliminary ratings were completed on or about that date and opened a Finalized Ratings claim. And then underneath all of that it has a closed case below that on 10/25/13, this is the preliminary ratings claim, while the Service Member is Active Duty. Service Members on Active Duty cannot have a rated VA benefit being paid to them, so a new case has to be opened for when the Service Member separates the Service. Once the Service Member becomes an official Veteran, the VA will start the Final Ratings claim as soon as they get the DD214.
Bobby's case may have been more simple than most and went through the process faster. Yours may be a little more complicated than most, mine took about 4 1/2 months at the VA because of how complicated things were. Hang in there, things will get better! You are on the tail end!!!

Did your case go to Providence or Seattle? Seattle handles more cases than Providence and therefore is a good deal slower. I had one unfitting condition and 7 total conditions. I hope you will se some movement in your case soon as I know all too well how bad the waiting game can affect you.

ranger2992,

Please see the attachment that shows what I see on ebennies when I click on the new claim.

Thanks,

It should go quickly now. The rater is putting it all together, and it will get looked at and approved, or sent back. Once that's done, it goes back to the PEB. Not sure how long the AF PEB takes, but the army is 2-4 weeks to get the 199 sent back to the PEBLO. If all goes well and you agree with the ratings, there is a 50/50 you could be home by Christmas :)

I am confused :(

1. What exactly is the rater putting together? My Proposed ratings or finalized ratings.

2. Does it matter that I am in the National Guard in IDES but not on orders?

3. My MSC told me that since I am not in a military status and not on AD that the VA would adjudicate the claim and start
paying me compensation as soon as they are finished with the new claim that was opened. Is this true?

The rater does all the leg work and then must have their work reviewed and approved. If you are going through IDES, then I would assume these are proposed ratings for the PEB. I am no NG expert, but I would assume that the PEB is going to terminate your contract with the NG and that will generate a DD 214. Once the VA gets a DD 214, they start on final ratings.

If somebody else knows different, please chime in

Joe

Essentially the timelines don't matter. I been waiting on ratings for 176 days. My ebenefits has not changed and prob never will. VERY FRUSTRATING! But there is nothing we can do about it. At least we receive some type of compensation (eventually lol)
