I am a chapter 61 medical retiree with just over 16 years of total service. I was Prior enlisted but eventually commissioned and retired as an 0-4. I am 80% CRSC approved and I’m 100% Permanent and total from the VA. My CRSC payment is only $28 every month. Would somebody be able to help me understand how this calculation works? I expected to get much more from CRSC than this. If there are any CRSC experts out there that would be willing to send me a DM I would appreciate it. I have all the relevant docs if someone would help me review.

Hello,

The information associated with all of the six numbered items below is needed. Incomplete answers will preclude an accurate estimate. Each numbered item below is a factor in the CRSC calculation.

1. High three base pay average for retirement or IF retired, your current DoD disability retirement gross found on page one of the DFAS RAS. The gross retired pay from your DFAS RAS is preferred since it presents a gross high three that include any COLA increases. Please indicate whether you are providing the high three average or the retirement gross found on the DFAS RAS. EXAMPLE: My high three average is $3333 (or alternative: Gross Retired Pay on DFAS RAS $xxxx.xx)

2. DoD disability retirement percentage. EXAMPLE: My DoD disability rating is 50%

3. Years and months of active duty EXAMPLE: My active duty 11 years and 3 months (Note: 11 yrs 3 months is not 11.3; it is 11.25)
Note: The creditable years of service (active duty equivalent) for a reserve calculation is determined by the sum of accumulated reserve points divided by 360.

4. VA compensation:
-- percentage
and
--amount
plus
--identify dependents by category and number EXAMPLE: I have 60% VA Compensation, $1600, Spouse and 6 children under 18
and
---Any SMCs awarded and amount(s) Example: I have SMC-K in the amount of $108.57

5. Approved or expected combat related disability percentage (application was required). EXAMPLE: I have 100% CRSC approved plus SMC-S approved as well for CRSC

6. Do you qualify for another type retirement besides CH 61 disability, including REDUX? EXAMPLE: Yes, I qualify for Reserve Retirement pay now as I have reached the age requirement

Note: All the info listed above is necessary. Often, the reply omits much of the needed info, precluding an accurate computation.

ALSO—please provide details from your current CRSC statement

Ron

Its because you maxed out compensation between your chapter 61 pension and VA. You hit the cap. Take your earned longevity pension earned and add it to your VA compensation and that's the most you can get. So basically all that you have been missing out on in to hit max compensation is $28 a month.

Ok thanks. So would be the Richard Star Act do anything more for me or not?

Nope. The Richard Star Act helps Soldiers max out compensation when they qualify for CRSC but the CRSC% isn't high enough to recoup everything that they lost. So imagine being in for 19 years and getting medically retired. That soldiers chapter 61 pension is offset by any VA compensation. Chances are that Soldier is missing out on 2k (Or more) compared to the combination of 47.5% longevity pay of their HIGH 3 + VA compensation. If they were married with 2 kids and qualified for 30% for CRSC their CRSC check would be $663.31 and so their CRSC doesn't make them whole since they are losing 2k compared to a Soldier who retired with a regular pension and got all of their pension and all of their VA compensation. That's where the Richard Star Act comes in. That Soldier would get the entire 2k even though their CRSC% wasn't high enough to cover that amount.

Main question: how much residual DOD, aka, what's the bottom line that you get from DFAS after your VA Waiver gets deducted? That residual counts against your CRSC amount that you can earn. Barring that there's not much more I can tell you without hard numbers as @RonG requested to be able to better respond to your inquiry.
