Changing from Honorable to Medically Retired

Good Evening,

This may be the wrong forum, but I could not find one that really fit my question.

I attempted to go through the MEB process in 2013 prior to separation from the Army in 2014. I was away from an Army base and seeing Air Force physicians. My PCM recommended me for the MEB, but I had to go to the nearest Army base. After meeting with the Army MEB physician he decided to not send me to an MEB and told me that since I was near ETS, I should just follow that process. I was unable to receive adequate support from my command and thus followed through with leaving with an Honorable Discharge. Less than 3 months after leaving the Army, the VA put me at 30% for the same conditions that I saw the MEB physician for. These ratings have progressed to 60% in a little over 2 years. All conditions were listed in AR 40-501 as being potential reasons for an MEB. I understand that this does not mean that they are automatic recommendations, but they are in there all the same.

I would like to pursue having my discharge changed from Honorable to Medical Retirement through the DRB or BCMR. My basis for this will be that the MEB physician at the Army base made an error and should have recommended me. The reason for pursuing this will be to have the normal benefits of a retired member as well as eventually applying for CRSC. Has anyone pursued this or something similar?

I have seen many cases like this with positive outcomes. It does take quite some time though. Try contacting Veterans Legal Aid.

Thank you for your reply to my message. Are you referring to the legal aid available at local VA offices or is this a specific entity? I looked on Google and could not find anything by that exact name. Thanks again for the help.

There are law schools with Veterans Benefit Clinics, but also local legal aide positions designated to help veterans.
 
I am sorry if I am in the wrong place, and am asking a question already asked but I was given an honorable discharge from the Army in 2013 there was talk that I should have been med boarded, but was told it takes to long and to let the VA handle it. After getting out I received a 90% service connected disability rating then a year later bumped to 100% due to breathing issues and sleep disorders. Can I get my honorable discharge changed to a medically retired?

It is possible, you would have to petition the ABCMR
