Can you get a higher than %50 rating from the Army for PTSD

I am close to getting my med board sent t the PEB. My Peblo is telling me that alll PTSD no matter what the severity comes back 50 percent. Is this true? I have Severe PTSD, Can the army rate you higher than 50% based on severity. My peblo says to wait for Va rating and that they can rate me higher in the PTSD scale? If it comes back from the PEB %50 Should I appeal it?
 
In 2008 it was congressionally mandated that all "unfitting" PTSD be rated a MINIMUM of 50% while on TDRL....after the reevaluation time and you are PDRL then they make the final % decision. Ive seen severe be rated 100%....
 
Thats what I thought.I know congress says it has to be a minumum of %50, I think my peblo just wants me to take the 50% so he can close my case. My psychiatrist said he rated me at the most severe ptsd. We'll see when my packet comes back.
 
I am at 70% for PTSD thru a Army MEB/PEB plus 30, plus 10 = 80 on TDRL, final exam in 2 weeks for PDRL currently 100% IU throught VA but not P&T
 
Actually Congress did not mandate the 50% minimum rule. It comes from VASRD 4.129 which has been on the books for years. It only applies to the initial rating causing release from active service. A PTSD rating can be less than 50% upon TDRL exam but if one is maintained on TDRL, their TDRL rating will be at least 50% even if the actual rating in less than that.

AmI reading this right? I have been diagnosed with Prolonged Severe PTSD, Sleep Apnea, bi-lateral knee pain, hernia, 2 herniated disks, etc... PULHES are 313223, They tried to get me to waive the PEB/MEB but I refused.

With the PTSD Rating, 50% from the VA, will I automatically get 6 Months of TDRL from the Army Board? Plus whatever they give me for the other stuff?
