Hi i am a SSG that deployed in 2005 to oif . I was a guard mobilized unit . I returned and was found to be 100% disabled from VA 100 % for PTSD alone ..and brain syndrome 30% ,tinitus 10% u get the picture . iI recived incap pay for 20 months ...was put on stopp loss due to unit redepoying and i was still a medical hold ...yes for over 3 yrs .....anyway i just found out in Feb this year ...that i was discharged for refusing an MEB , mind u theres nothing that i signed or anything ...heck i was waiting on my peb .....I am so confused ...I have called my congreesssman ...huh what a joke ....My Senator office was checking on it >>>>Now two months later they tell me i cant draw retirement and va comp ...told them tey are full of it ...than he said well thet say u refused an MEB ....What bulll ......Can somone help[ me pleases ...I cant do this much longer .....MIke

I've read your post over a couple of times. I can not figure out your question.
 
You need to ask to see paper workt If you were to have a meb you should have signed a briefing. Start asking for things in black and white
 
I am sry i didnt make much sense ....I have been in the Army for over 20 yrs 14 yrs active 7 national guard .I was deployed in 05 and was injured ...when we got back ,,,i was released from AD ....then i was still in the guard ....MY unit has done everything to help me ...I am and was deemed 100% disabled from VA for just PTSD alone ....I was waiting for a MEB , i have been waiting for yrs .... I just recieved my discharge from the National guard it was not a medical ,,,it was just an honorable. My G1 CSM told me that he had put me on stopploss , so that i didnt fall through the cracks ...welll i have ......The Brigade Commander and all medical staff had known i was waiting for a medical bopard ......i didnt get it i just got discharged ...I have talked to my Senator ....and he said for me to sue them cause his office hands are tied ...I have all LOD that were done from NGB and commanders letters ,I even have a copy of my MRP2 packet that was submitted and approved not once but twice ,but no orders ever arrived ....I need a lawywer I cant deal with all this lying and passing me off to other ppl that dont know crap...... Just for example the rep from SEn Wickers office told me i couldnt draw my ret and va at same time ....so he said he dont know what i want to get out of the congresstional ....That was the congresstional ,that confersation what a joke ...So here i am Injured from combat and was just thrown out ....while i was already 100% through the VA and waiting on PEM/MEB Please Help Thank everyone for the sacrifice for our country ....Too bad our country dont care about us .....By the way I was also in Desert Storm ......
 
You need to file against the ABCMR so they can/may upgrade your discharge to a retirement. Do a search on that acronym and you will find lots of information here.
 
Going to ABCMR is one choice, though, I tend to see a possibility of suing for wrongful discharge (which would get you active duty back pay and credit you with the time for retirement purposes).

So, the choice is suing the government or filing with the BCMR, generally. You have to weigh the pros and cons, but I tend to think you will get faster and better relief with a suit rather than through the BCMR.
 
Thank u for all the Info ....I have to and want to sue ...I and my family have suffered under incompetent hands for way to long ....If anyone can put me in the right direction for a lawyer I and my family would be gratefull ....Thank you , MIke

The meeting u had with the senator on May 10th is exactly what im a prime example of ...I have been waiting almost 4 yrs ..While all along no one will exept the responsibility of making a very bad decision... MY G1 CSM said in his own words ...I knew i shouldnt have discharged you ... I was told they were trying to find a way to put me back on duty ...That has been almost 3 months ... A congrestional investigatin was started on * July 2010 and the out come is a joke ...No paper trail it was just phone calls from the Sen aide to the same ppl thAT DID THIS TO ME AND OTHERS IN ms. wE NEED HELP ....
 
Please can somone point me in the right direction for a lawyer that handles DRB /peb/meb I looked at my DD214 it has a reenlistment code RE 1 HOW CAN SOMONE THATS DEEMED 100% DISABLED WHILE ON DUTY AND THEM JUST DISCHARGE THEM WITH JUST A 4187 SIGNED BY AG1 SGM saying soldier did not want MEB ,,,no paper work or anything ,,just his word ...the same man that had me put on stopp loss begging April 2008 for medical hold then ...2 yrs later just a honarable disharge I and my family are owed alot of moneyfor back pay ......Anyone with some knowledge of a lawer would be much appriciated'''thanks Mike
