Appeal denied

Hello,

I just appealed my narsum from MEB because it was missing information/inaccurate information and the unfit condition was of only one condition when I have multiple conditions from a accident while on duty.
The appeal results came back and they denied it.
My PEBLO had me sign the appeal within a 12 hour window and my lawyer has yet to get back with me.
Is this normal? PeBLO said I will have another chance to appeal after receiving ratings, but I gave very clear and accurate information to my lawyer and the other conditions should have been a GO.

Thank you for any help!

I had the same issue, they referred me for 1 condition when I had 3. But I never had to "appeal" it. PEBLO said the doctor just had to agree to add them.

To my understanding, anything you claim can be added as a referred condition.

I didn't know they could "deny" an appeal. I am sorry that happened to you.

When they say you can appeal it again, it is after you've received your VA/DOD and you request the FPEB.

Your PEBLO should have granted you an extension for your lawyer to get back to you.

They didn't deny my appeal. They denied adding the other 2 conditions as unfit conditions. Sorry if that was worded badly.
So, the most pronounced injury of my accident was my shoulder and medical only put that on my profiles. A year later my neck/head now have issues from the same accident. I added this to my profile and it became permanent. Thats what started the med board process.
And yes she said I can appeal again after receiving my dod rating. After doing more research, I was not aware of a informal and informal PEB.

Okay cool. Best of luck. Hopefully you get what you want and don't have to appeal. I was told it can add 3-6 months to the process.
