Advice for FPEB please??

im getting ready to see formal board sometime soon and the Air Force is giving me 20% for labral tears and degenerative disease to left shoulder, but another one of my conditions is left radial nerve entrapment/ dystrophy of left upper extremity (which was caused by first shoulder surgery) and that was rated at 20% do you think my odds are good at getting that added to the unfitting category since the nerve stuff is from the surgery? thanks.​
 
If you can support this by an EMG or medical doctors statement they would have to consider this. Talk to your PEB JAG and see if they can request this as a Medically Unacceptable and if at the PEB they would have to determine if Unfit for your Job. If so, and you can support nerve damage then ask your JAG for a seperate rating. If they don't allow a separate rating , which the should for nerve damage, then request that added as secondary condition which may increase your rating.
 
its all in my medical records about the nerve damage and also i currently take medication for it everyday to help subside the pain from the nerve damage
 
no i havent talked to any jag at all, i still havent went to formal board yet im waiting on a date to go there.
 
i have the same issue, still at the first part of PEB phase though, would like to see how this plays out keep us informed please.
 
I have labral tears and severe arthritis and other various issues, they did surgery about 4 months ago and the ulnar nerve was damaged in the procedure. Entrapment around the elbow for the ulnar nerve
 
I've got radiculopathies in both arms, a labral tear in the right shoulder, and underwent surgery for ulnar nerve release left elbow. Left side radiculopathy, left side ulnar release, and right side labral tear weren't documented until after my Narsum. IPEB has initially rated me at 10% for the radiculopathy on the right side (insulting; that is only for loss of sensation isn't even mild rating for nerve damage) I had a nerve conduction study done by the army about 18 months ago. Refused to accept 10%, so I paid a civilian doctor $500 to perform another emg and nerve conduction study. Have submitted that along with the left side emg, left side nerve conduction study, physical therapy, and ROM records to VA for reconsideration. Didn't address my labral tear at this point as I was afraid it would cloud the issue regarding nerve damage ROM limitations. Will post the results when I get them.
 
Just a quick procedural point-

Generally, it is best to do the VA rating reconsideration after the Formal PEB. That is because the VA rating reconsideration can only consider "PEB referred" conditions, and so, until you have nailed down the unfitting conditions, you won't get the "full picture" looked at by the VA.
 
thanks for the info Jason if formal board doesnt work out i will do the one time VA reconsideration.
 
Adding conditions is tricky, especially if those secondary/tertiary conditions are manifestations of another injury. The Formal PEB can be hypersensitive to this and more often than not, they will initially view it as piling on or "pyramiding". Your legal counsel should be able to determine if it is in fact pyramiding. Whatever you do, don't exaggerate any condition you may have, for the boards sake. Most folks dont, but I could tell some stories (of course changing the names to protect the guilty). Cheers.
 
I just met the Formal board (Air Force) this week and was sucessfull at getting a category 2 condition changed to a category 1. With that said mine was dealing with my back. I was given crap info from my peblo on the process so I took it upon my self to get the number to the FPEB Airmans councel lawyers and called and discussed over e-mail and phone my intentions. This was the smartest thing I did as they provided great info to prepare and gave good advice as to the possible success. The number to the legal staff that will represent you at lackland is DSN 473-4295 Good luck!
 
thanks for all the info guys it is much appreciated, i just wish i would get a formal board date soon, i signed my paperwork on 17 August and was told it would take up to 14 days to get a email saying when i need to arrive for the hearing and it has been 25 days.... i guess i wouldnt expect nothing less since they dont seem to follow timelines on anything in this process.......
 
Formal board results are now 40% instead of 20%!!! Anyone know how long until I can expect retirement orders??
Should not be more than a few weeks. You can look at other timelines to see what has been the trend. My last two trips to the AF FPEB, they have been talking about getting a lot of pressure to move cases faster, so I think you will see some faster processing overall.

yea things at FPEB didnt take long at all, they did a summary adjudication didnt even have to have a hearing...
