Add Dependent to VA compensation

My wife just gave birth to a little girl. Does anybody know how i have my compensation adjusted to include my new little girl?

This may help, from VA regulation M22-4. Nothing is easy with the VA and it is wise in any case for your newborn to have a social security number as soon as possible. Depending on where you reside you may get some guidance from a state or local VA representative also on how to initiate the process. Congratulations and good luck.

9.03 ESTABLISHING DEPENDENCY

a. Written Statement as Acceptable Evidence. 38 CFR 3.204 was revised effective November 15, 1996, and now states that, except as provided in paragraph 9.03c, VA will accept the written statement of a claimant as proof of marriage, dissolution of a marriage, birth of a child, or death of a dependent, provided that the statement contains the date (month and year) and place of the event, and the full name and relationship of the other person to the claimant. Where appropriate, the statement must have the name and address of the person or persons having custody of the claimant's child. Also, a claimant is now required to report the social security number for each dependent claimed. (See par. 9.06. See subpar. c below for exceptions to 38 CFR 3.204.)
 
fortunately this process wasn't as complicated as other va processes. I just had the social in hand of my newborn and went to a DAV rep (am sure other reps can help, too w/ this) with it. The dav person helped file whatever was necessary (i don't believe it was much paper work thankfully) and within 2 mos. the # of deps I have was correctly notated w/ the VA. done this "activity" 2x since being involved w/ the va system, and will have to do it again shortly! good luck to you, no worries, it's not that bad. and congrats!
 
I didn't have the birth of a new child, but I did have to file information to have my stepdaughter added as a dependant on my VA compensation... and they did backdate my pay. Your best bet is to call the VA directly and make sure you file the correct information. In my case, it kicked in almost immediately. When I spoke to the VA I got a fax number to send the information to. It's not really a difficult process as long as you speak to the correct people, and I would keep doing so (bugging them) until you know for sure that they have the right information. On a side note, I'm sure they will backdate your pay to the month your child was born.
 
My husband's disability was raised to 40% so his pay was raised starting in August. The V.A. however refuses to input the information of our eight children and I so that it can be raised to the right amount even though they received the paperwork two days after we received his information. It has been 8 months now. The last person he talked to at the V.A. actually said it isn't a priority.
 
I have a question. My husband is at 70% and we just found out since May 2009 he has only gotten paid for having a spouse. My daughter, his stepdaughter was his dependent while he was active duty. He was informed several times he as getting the pay for having a spouse and dependent, but that is not correct we just found out. To add to that we had one baby in May 2010 and another in May 2011. My husband submitted birth certificates for all three children and social security cards along with marriage certificate in May 2011. He was told step one of the process to add dependents can take up to 180 days and every time he calls to check the status that's all they tell him, nothing more. Is he eligible for backpay at all? I feel really cheated because he has missed out on over two years of receiving pay for our oldest child.
 
He should be back paid. If he is not, he will have to appeal. I hope it works out with minimal effort on your part. Good luck!
 
We are still waiting (almost 3 months since filing birth cert and social). Is there backpay for this?

You will get the back pay, who are you doing all of this through, if you go to the benefits office, they can do it for you, and it starts almost right then. B.C. texasorange1@hotmail.com.
 
The whole VA dependent thing is screwy. I've been married to my wife for 15 of my 17 years in the Army, and I just found out that we won't be receiving her part until we fix the issue because her divorce decree from 18 years ago wasn't submitted. Our children's portion is fine, but apparently the Army/DEERS/the State of TN (okay, I probably shouldn't have mentioned that last one) can't be trusted when it comes to determining the legitimacy of a marriage.
 
Going on 21 months to add my wife. They sent me the same letter indicating other cases/issues took priority. Good info above guys, thanks. Maybe someone at the local VA will be able to work some magic when we have to add another dependent in September.

WOW... Thats crazy! 15 years latter! Figure your local Finance office while AD would of caught that 14 years ago!

Maybe you should move to Texas, I have heard some nightmares about TN. One thing about the VA, DAV, or any of the organizations that you go through they are very through on the dependents part, w/ the amount of time that has went by I am not sure what they will do, you need to get your wifes divorce finished. Rereading, I didn't word my post very well. My wife's divorce was fine and complete at the time of our marriage. The issue we had with VA was that we didn't submit the decree with our VA claim (missed the part of needing it I guess). It just baffles me that they take issue with it, even though she's legitimately (in DEERS)/(Everything thing else stating she's a dependent). If something happened to me on one of my 7 deployments, would she had to have the decree in hand for everything had I not returned? Been around long enough for nothing to really surprise me, so don't take this as complaining, just pondering...
 
It's one of those cases where the VA and DEERS don't communicate. It seems like they should or do, but the reality is they don't. Hope it finally gets straightened out for you.
 
The major problem is the lack of communication between the VA and DEERS/RAPIDS, DOD, ARMY, AF, etc. This system will never work efficently we need more than the new IDES system....
 
Hello everyone, I have a quick question. Me and my Vet DH got married last 2009. We didn't know that we need to file for the dependency back then last 2009. So last year Dec 2011 we filed the Dependency , so my question is does the VA will pay us from the date that we got married? or we gonna get paid only from the time we filed the claim? Thanks in advance!

My child is supposed to be added as a dependent to his dads VA compensation. He supposedly filed for this in Nov of 2010. They are still in processing to this day. He and I do not get along too great but he doesnt have the greatest track record of being honest. Our child is now 6, we were never married I had him about 3 months after he got out of the Army. He receives his benefits, he is just trying to add our son so that our son can receive compensation, as he doesnt pay child support. Is there anything that I should be doing? What info will the va need from me? I have moved states from when he applied so how can I change my address to send me info? I have never spoke with anyone at the VA so I am just worried I am getting the run around with it all. I am not trying to be money hungry or anything but being as he doesnt help out in anyother way if our child is entitled to benefits on behalf of his father then he deserves to get them. Can anyone give me any insight?

You will probably get about 113 per month. You can petition the VA to have it sent directly to you. Contact your regional office.
