70% DOD Rating and 100% Proposed Rating VA | IPEB Question

Details :
DOD Unfit Conditions:​
Severe Obstructive Sleep Apnea/Hypersomnia = 50%​
Bilateral Pes Planus = 30%​
50% + 30% = 65% rounded to 70%​
VA Rated Conditions:​
A lot Including these^​
Ankle tendonitis, Achilles tendonitis, Migraines, lumbosacral strain, peripheral neuropathy and more.​
Question 1: Since I met the 30% Requirement and will be Medically Retired, and got a proposed VA Rating of 100%, and I do not qualify for CRDP, should I concur or is there more stuff to look at?

Question 2: I was first assigned CPAP for my OSA, I stopped breathing 40 times every hour on average, I was not compliant due to maxing out the pressure and my airway was still collapsing causing me to subconsciously rip off the 4 different masks I tried. Then tried a dental appliance that felt like it worked a little bit, but was causing pain in jaws longer than it was supposed to, but did not get a sleep study due: I got a septoplasty, and a sliding genioplasty. Post surgery I was told that before the surgery my airway would completely collapse and after the surgery it was about 50% open. I have not had a sleep study done due to recovering from the surgery. I know I still have apnea, but would getting this surgery disqualify me from the VA benefits regarding OSA/Hypersomnia?

I don't see any need to contest it if you feel you are rated properly when comparing the ratings for the VA with your symptoms. You are almost maxed out for DOD % anyway. I would concur unless there was something I thought was wrong and it was worth fighting for. 70% DOD and 100% VA is super close to the maximum you can get by law. For reference the highest DOD % allowed for purposes of being paid is 75%.

Take the VA 100%. You and your family would better off in the long run. You will be able to have other benefits at VA 100%, dental, insurance and educational for your family. You earned the right to have those disability amount of 100% VA rating. Keep in mind, alot of services members leave without any benefits and have to work their enter lives to take care of their family. You can atleast work part-time and received your VA benefits.

I suggest finding a new identity and working full time. You can play the vet card or you can flip the page and contribute

Hello,

Accepting VA compensation is the best option, even in cases where the DoD percentage amount results in a higher dollar amount.

The retired pay is reduced dollar for dollar in the amount of the VA compensation and if residual (left over) retired pay remains, the retiree gets to keep it PLUS the VA compensation.
