I was medically retired at 70% in 2016 based on a 10% (original reason for the board) unfitting condition and a secondary 70% condition; there were two secondaries also at the time of PEB 10% right leg and 10% left leg at the time that were not considered by the board, I never thought to make the argument at the time that these were unfitting conditions. My question is should the board have considered all the conditions at that time?

70, 10, (10, 10 bilateral) combine to 78% which would have resulted in Med retirement at 75% DoD.

The conditions worsened a few years after retirement to 40% primary PEB condition with 70% secondary and (20% right, 20%left, 20%right, 20%left secondaries; 2 nerves each leg) does this warrant reconsideration of my retirement percentage?
 
If unfitting conditions were not considered you can ask the BCMR to look at your case. It is two+ year process. The BCMR will only consider the conditions at the time of discharge. Conditions that get worse can be considered by the VA, but not the DoD.
