UTARNG loss of active duty orders in the middle of a PEB

Update 2012. The informal PEB decided that I should be temporarily retired. I faxed copies of Dr. notes to my legal representation in Ft. Lewis where I was supposed to go for the Formal PEB, since I requested one. The JAG officer looked at my paperwork and took them over the PEB and instead of...

    Good news / Bad news

I got good news yesterday. The JAG advocate at Ft. Lewis called me and told me that he showed the PEB my recent documentation stating I was stable and they just adjusted the findings instead of going through the whole DVA process again. I am being permanently retired at 70% as soon as Washington...

Can TDRL be challenged for PDR in the initial PEB findings?

Just received my PEB findings. Today I have to decide to challenge it or not. I have 70% disability from the Army and TDRL. I am fine with the 70%, I am just wondering if it is possible to actually challenge the TDRL for a permanent retirement.

    PEB challenge???

Well right now in the "PILOT" program the VA gave me 70% and the iPEB accepted the finding and offer 70% TDRL. Yes the 70% is for a combat related issue and yes it has already been proven to both the Army in the PEB (it says in their findings) and the VA. The only issue I have is the PEB says...

    PEB challenge???

From what I understand, the difference, or most basic consideration for being PDRL instead of TDRL is stability of the condition. I have had the issue since 2005, here it is 2011. The Docs I see pretty much see it as "stable" (as stable as PTSD gets) and don't forsee it changing much. I don't...

When should I get a lawyer for the MEB/PEB process?

What was the benefit of having the DAV represent you? Did it help? And would you suggest it?

    PEB challenge???

So I got my PEB findings back with 70% combat related PTSD. They want to put me on the TDRL and see me back in July 2012. I talked to the PEBLO and he said to challenge the TDRL, but not the percentage. I am skeptical because I am paranoid they will change my percentage if I challenge...

UTARNG loss of active duty orders in the middle of a PEB

Ok. So I received my PEB findings. They say 70% combat related TDRL. I am fine with the percentage, but I am not happy with TDRL. I was told it is automatic usually. So, I guess I will have to have a PEB hearing. My PEBLO said they won't mess with my rating if I just challenge the TDRL. Is this...

    Promotion upon medical discharge

So does this apply to soldiers injured during OIF even though they have been released back to Title 32 counter drug active duty orders as well?

UTARNG loss of active duty orders in the middle of a PEB

Today I was contacted back by a Senator and Congressman with electronic generated emails that they had received my letters. Hopefully they will be contacting me soon for more details. Although, I was pretty detailed in my letter to begin with. I got a hold of HRC.IG US Army. I was contacted back...

UTARNG loss of active duty orders in the middle of a PEB

So I am reading through the DoDIs you posted for me. I have a TBI, so it is kind of difficult for me to understand this. But from what I got, based on the DoD 1241.2 section 6. I was on orders longer than 31 days, so for them to take me off active duty, I have to request that be done, they can't...

UTARNG loss of active duty orders in the middle of a PEB

My name is Luke Nielsen. I have posted here before, but I am not sure I was clear and need some help from other guys seeing similar problems. I joined the National Guard in 1996. I completed AIT and basic in October 1998. I went onto active duty Title 32 orders for Counter Drug in July 1999. I...

    Where Does the BS End???!!!

Seems to me it is just a bandaid on the wound. Just because they numb it does not mean it is still not an injury. Surely they understand that. You body hasn't repaired, it is just not feeling what your body is telling you. Seems like the Blue Weenie strikes again... (Green weenie for us grunts...

    Where Does the BS End???!!!

My UA called me up yesterday and he is a good guy. (war buddy of mine) He is trying to reread the regs and make sure of things, but he hinted I write my congressman anyway. I told him I was considering this. He seemed a bit irritated. Not at me, but others. Maybe they are trying to railroad me...

    Where Does the BS End???!!!

I appreciate the quick response, and hope you find resolution to the issue yourself as well. Unfortunately I am Army guard. Does this make a difference in the paperwork you linked to me? I agree that they should keep me on active duty to full resolution. I already know based on what my PEBLO...

    Where Does the BS End???!!!

Hello all. I am in a similar boat. I was injured in Iraq with several conditions that are unfit for duty. Since returning from Iraq in 2006, I was put on FTNG orders and the problems worsened. I was referred to a medical board but they drug their feet and it has been two years now. I have...
