Question for Jason Perry about pursuing action in federal court

Sir, I have a question. I was medically discharged with 0% in 2005 due to bilateral plantar fasciitis post surgery with no relief. I did the PDBR in 2018 and received a decision just before they changing the rating code giving plantar fasciitis its own rating. Afterwards, they came back with...

    BCMR fairness and equity

I spoke with an attorney today about my PDBR case. Basically, I was medically discharged in 2005 from the Army with 0% unfit rating for bilateral plantar fasciitis post surgery. I applied for the PDBR in 2018 and was given a decision in May of 2020 that upgraded my rating to 10% for each foot...

    Basis for appeal

I hope someone with some legal background or experience can assist with this. What are the reasons you could appeal a PDBR case to the US Federal Court of Claims? I know that PDBR’s only option is to appeal at this legal but I didn’t know what would be basis for an appeal.

Does anyone know if there is anything that can be done if you were medically separated and rated by the Army using an analogous code and now they added an equivalent code for your exact condition in the VA CFR 38 book C? Thank you!

PDBR results and now there is a code for plantar fasciitis

I received my PDBR results last week. They rated me 20% under the closest code they could find for my bilateral plantar fasciitis post surgery. Today I found out that the VASRD was updated to include a code for plantar fasciitis. “ 5285 Plantar fasciitis: No relief from both non-surgical...

    Mistake on PEB findings

I was reviewing my PEB findings from 2005. It said I had “normal imaging” as a part of the write up to give me 0%. I don’t remember having any imagining for my plantar fasciitis while on Active Duty. It also wasn’t mentioned in my NARSUM by the doctor. Wouldn’t it have been mentioned in the...

    Plantar fasciitis

Is the DOD rating for plantar fasciitis based on range of motion? I have pain when walking, standing or any pressure on my feet. I cannot walk longer than 10-15 minutes without sitting. I didn’t know if the ratings(I know there are several codes since there isn’t one for plantar fasciitis) had...

Having a tough day with the waiting

I'm having a hard day. I submitted my PDBR application in April 2018. I was medically separated in 2005 with 0% unfit but immediately rated at 30% for the same condition through the VA. The waiting game is hard. I may have another year or so left to wait. Someone tell me that my service to...

    PDBR

The wait for the PDBR is terrible. Every few months I wonder where I'm at in the process but I don't want to bug the board. I mean, I've waited 14 years for justice. I hope that the board is making decisions that accurately reflect the guidelines. It's been tough to wait so long.
