    INCAP Pay

Not completely sure what you are asking. That said, you can’t get INCAP pay (like many entitlements) unless you apply for it. I had a client many years ago who we applied for INCAP pay for and we ended up with more than a $100k payment to him. Never would have happened if we didn’t ask for it.

Sailors and Marines separated between Sept. 12, 2016, and June 11, 2018 eligible for new PEB

Not sure what is really going on with this thread. I get the idea of hiring a "private attorney." Joel Petit is mentioned in the earlier posts. I am a friend and colleague of Joel, and he is one of the few attornies (the other being Jack Gately) that I would recommend folks consider for legal...

    100% VA proposal question

They will only state up to 100%. I am more curious about whether you have asked the right question or if you think you can get above a 100% payment (75% on the DoD side). Are you thinking that the payments can go above 100%? (They can't be on the schedule, but you can get Special Monthly...

Referred condition--how likely can I add a second one?

Military medical providers often use terms like "offer" to describe your "options" for an MEB. In a way, that makes sense because unless they refer you, the MEB will often not happen. However, I don't like to think of it in those terms. If you have a condition that fails retention standards, you...

Hey, PEBFORUMers! I have exciting news to share (I think)! I just upgraded the forum software from version 2.2 to 2.3. What does that mean? I am not sure....but here is what they say: Dark mode Performance enhancement Changes to editor Apple ID login (but, I have to figure out how to implement)...

It certainly sounds plausible that you might qualify for CRSC. In your case, I think you have to fight it out (i.e., apply and see what they say) to know. Here's a major point—if you don't apply, you can't get CRSC. So, in most cases, it makes sense to apply (and build the best case you can)...

Tommy, Thanks for posting here, and I am happy to share my thoughts. Remember, none of this is legal advice- I can only offer that to clients. Yes, if you are referred to the MEB/PEB, you can argue for any or all conditions. However, I am not 100% clear if the IRILO resulted in your referral...

    CRSC

This is spot on.... many "veteran-friendly" or "pro-military" pieces of legislation are brought up every year, get support on paper, and then don't pass. On the other hand, things that greatly benefit many servicemembers or veterans, such as the PACT Act, do pass. My opinion is that it is best...

MEB at 18.8 years active Army, COAD?

COAD/COAR are, in my opinion, options of last resort. They used to be more commonly granted. In the last ten years, I have seen very few of these options being granted. Take my views with a bit of a grain of salt, as I don't have a view of the total number of cases. I can only comment on what I...

    Examiners Missing Active Time

I'm sorry to hear of your problems. I will offer some thoughts, but you apparently have a lawyer representing you, so you should talk with them about your questions. Do you have any LODs for these conditions? Or medical records showing treatment for these conditions while in a military status...

    Med board for mental health

I am sorry to hear about your problems (both from the mental health perspective and the impact on your military career. What I am not clear about is your immediate goal. Do you just want a separation from the military? Or do you want to get what you are due if your condition(s) are unfitting...

Thanks for your post. I am sorry to hear about what happened to you. There are two options when seeking a military disability retirement after separation from service. If you did not have a PEB before separation, the most likely procedural option is to apply to the Board for Correction of Naval...
