What does 100% permanent and total disability mean... is that the same as just getting 100% in terms of chap 35 benefits?

When a military service-connected veteran is designated with a "total disability" rating (i.e., P&T or TDIU) from the DoVA, they are eligible for additional DoVA disability compensation benefits.

One in particular is Chapter 35: Survivors & Dependents Assistance (DEA) benefits. Dependents' Educational Assistance provides education and training opportunities to eligible dependents of certain veterans. The program offers up to 45 months of education benefits. These benefits may be used for degree and certificate programs, apprenticeship, and on-the-job training.

If you are a spouse, you may take a correspondence course while remedial, deficiency, and refresher courses may be approved under certain circumstances.

For eligibilty purposes to Chapter 35 DEA benefits, an individual must be the son, daughter, or spouse of:
  • A veteran who died or is permanently and totally disabled as the result of a service-connected disability. The disability must arise out of active service in the Armed Forces.
  • A veteran who died from any cause while such permanent and total service-connected disability was in existence.
  • A servicemember missing in action or captured in line of duty by a hostile force.
  • A servicemember forcibly detained or interned in line of duty by a foreign government or power.
  • A servicemember who is hospitalized or receiving outpatient treatment for a service connected permanent and total disability and is likely to be discharged for that disability. This change was effective December 23, 2006.
For the period of eligibility, if an individual is a son or daughter and wish to receive DEA benefits for attending school or job training, you must be between the ages of 18 and 26. In certain instances, it is possible to begin before age 18 and to continue after age 26.

Moreover, marriage is not a bar to Chapter 35 DEA benefits. If an individual is in the Armed Forces, he/she may not receive DEA benefits while on active duty. To pursue training after military service, the individual's discharge must not be under dishonorable conditions.

DoVA can extend an individual's period of eligibility by the number of months and days equal to the time spent on active duty. This extension cannot generally go beyond an individual's 31st birthday, although there are some exceptions.

If you are a spouse, DEA benefits end 10 years from the date the DoVA finds you eligible or from the date of death of the veteran. If the DoVA rated the veteran permanently and totally disabled with an effective date of 3 years from discharge, a spouse will remain eligible for 20 years from the effective date of the DoVA rating. This change was effective October 10, 2008 and no DEA benefits may be paid for any training taken prior to that date.

For surviving spouses (e.g., spouses of service members who died on active duty) benefits, it end 20 years from the date of death of the service member.

In retrospect, Section 301 of Public Law 109-461 adds a new category to the definition of "eligible person" for DEA benefits. The new category includes the spouse or child of a person who:
  • VA determines has a service-connected permanent and total disability; and
  • At the time of VA's determination is a member of the Armed Forces who is hospitalized or receiving outpatient medical care, services, or treatment; and
  • Is likely to be discharged or released from service for this service-connected disability.
Special Restorative Training is available to persons eligible for DEA benefits. The Department of Veterans Affairs may prescribe special restorative training where needed to overcome or lessen the effects of a physical or mental disability for the purpose of enabling an eligible person to pursue a program of education, special vocational program or other appropriate goal. Medical care and treatment or psychiatric treatments are not included.

Special Vocational Training is also available to persons eligible for DEA benefits. This type of program may be approved for an eligible person who is not in need of Special Restorative Training, but who requires such a program because of a mental or physical handicap.

As previously mentioned by multiple PEB Forum members numerous times, you should await receipt of your DoVA final ratings else upon CRSC application submission, your opportunities to receive a favorable CRSC decision with DoVA proposed ratings shall decrease significantly.

To that extent, as documented on the DFAS website, you should submit a CRSC application if:
  • you think you are eligible for CRSC and have never applied.
  • you have been approved for CRSC, but you have more disabilities that you think might qualify.
  • the VA has recently added more disabilities to your rating that you think might qualify
Moreover, how to apply for CRSC is outlined as follows:

1. If you are applying for the first time, complete DD Form 2860. If you are reapplying for new disabilities, request a reconsideration application from your service branch.
2. Include documents you feel will help your case. These might include:
  • Retirement orders
  • 20-year letter or statement of service (for reservists)
  • Relevant pages in your VA or service medical record
  • VA ratings
  • Purple Heart award citations
  • Retirement Form DD214
NOTE: Your branch will make decisions based on what you send. The quality of the information is more important than quantity. Send copies, not original documents. Your branch will not return them.

3. Mail or fax your application to your branch of service. You can’t submit it electronically.

4. Your branch of service will notify you of their decision in writing. If approved, they will forward us a copy of your approval letter.

5. We will start your monthly payments 30 to 60 days after your branch sends your approval letter. We will make any retroactive payment due 30 days after making your first monthly payment.

We received your claim on June 29. 2012, for multiple conditions at the Seattle Regional Office (RO).

Our records indicate a preliminary rating was completed on December 31, 2012. The rating was forwarded to the Physical Evaluation Board (PEB) for review. We are currently awaiting guidance from your PEB. We show your DD-214, Certificate of Release or Discharge from Active Duty, was received at the Seattle Regional Office (RO) as of May 9, 2013.

The woman i spoke with said that Seattle RO needs my DD214 to complete my claim and provide me with that glorious letter and/or phone call

I have been out of the army since Apr 14 2013 and on RET list since Apr 15 2013

So due to the fact RO just receiving my DD214, that means PEB is done with their part. Can anyone help?

I retired April 18th and the VA told me the exact samething, that they are awaiting the PEB, I'm not sure what they need from PEB, the VA has had my DD 214 before I even signed out for terminal leave
 
Update:
Being free never felt so great! Made my long drive from Alaska to Ohio. Glad to be home. Now just got to wait for terminal leave over and va to finish their side. Until then I'm going to school and enjoying every minute of my retirement! Hope everyone has a great outcome! Thanks for all the support and help.

Yea well what the lady said was PEB sent Seattle my DD214 and she said I don't see us needing anything else.
 
How long has it taken everyone from when their ebenefits changed to prep for decision until they finally saw their ratings. Mine changed to prep for decision on 4-30 and had a suspense date of the 9th but there still hasn't been any changes on ebenefits and my DAV rep told me its day to day at this point or it could be 30 days. Im just trying to guesstimate how much longer I may still have.

There saying don't go off of ebennies bec its not updated on the regular.

So...calling them yourself doesn't do any good but when u get a DAV-Rep the actually tell them whats going on? How do i get in touch with someone local like that? Do i just go to one of these local VFW?
 
Brandon the DAV is able to access the actual files online that VA uses for the rating boards. Here is a link to the DAVhttp://www.dav.org/veterans/NSOffices.aspx I see your retired as of 18 APR congrats. They should be able to tell you whats going on with the finalizing of your claim if you haven't seen anything yet.
