I was injured during annual training this year and my LOD was previously approved and my incap also. My RNCO doesn't know when i'll receive my incap pay and they want me to file my civilian insurance to see the orthopedic doctor. I'm confused and i'm about to be evicted from my apartment and all my bills are past due. Any information will be helpful for me. Thanks

ACCOMPLISHMENTS: In 2011, we met 155,984 needs for military families, including active duty, Guard and Reserve members from all branches of service. Since its inception, Operation Homefront has provided more than $92 million dollars of funding to programs to benefit military families.

KEY SERVICES: Operation Homefront provides direct services to alleviate a military family’s or individual’s actual/complete emergency financial burden, as well as counseling and/or recovery support. Emergency financial assistance is in the form of checks paid directly to mortgage lenders, auto mechanics, contractors, hospitals, doctors, dentists and other providers. Other emergency funding assistance, which an applicant receives within 24 to 72 hours, includes the following:
  • Financial assistance
  • Emergency food
  • Emergency home repairs
  • Critical baby items: formula, food and diapers
  • Home and appliance repair
  • Furniture and household items
  • Local moving assistance
  • Community events
  • Wounded Warrior Transitional Family Housing

BACKGROUND: A 501(c)(3) nonprofit organization, Operation Homefront was formed in February 2002. It was developed to support the families of deployed service members immediately following 9/11. Operation Homefront is headquartered in San Antonio, Texas, and has evolved into a major nonprofit. The organization currently provides services to military families across the nation with 23 chapters serving 27 states. The national office handles cases in states that do not have their own chapters. The majority of our clients are the lowest-paid service members, the E-1 through E-6 enlisted ranks.

The target population is American military personnel and/or their families who have unmet needs due to financial hardship, death, injury, or physical or mental detriment as a result of service in Iraq or Afghanistan. These may include active duty, Reserve, National Guard and veteran service members. They are a diverse ethnic group (64 percent are minorities): approximately 20 percent are African-American; 5 percent Asian-American; 34 percent Hispanic/Latino; 5 percent Native American; and 36 percent Caucasian. Roughly 75 percent live at an income level 80 percent below the median income for the communities in which they reside.

We’re proud to earn the highest rating – four stars – for five straight years from Charity Navigator, the nation’s top independent evaluator of nonprofit organizations. Nationally, $.94 of every dollar donated to Operation Homefront goes to programs.

I hate to say this but I'd recommend filing a Congressional Inquiry. Someone dropped the ball somewhere. If you file a Congressional you'll get a higher headquarters involved in determining the status of your incap pay and follow-up medical care. Your medical care should be managed by the Patient Administration Division (PAD) of the Army hospital (MEDDAC) with geographical responsibility for your unit.

MY UNIT IS HELPING BUT THEY CAN'T GIVE ME AN EXACT DATE TO WHEN I WILL RECEIVE MY INCAP PAY, I HAVE A DOCTORS APPOINTMENT TODAY AND THE UNIT SAYS TO GO AHEAD AND FILE MY OWN INSURANCE.
 
how long ago did you file for Incap?

MY INCAP PACKET WAS APPROVED ON WEDNESDAY OF LAST WEEK, BUT NOBODY WILL GIVE ME ANSWERS AS TO WHEN I WILL RECEIVE MY PAY CAUSE I REALLY NEED IT CAUSE OF ALL MY BILLS ARE DUE PLUS MY LANDLORD IS GETTING REALLY IMPATIENT WITH ME.

Ask your unit administrator to call DFAS to determine the status of your incap payment.
 
I TALKED TO SOMEONE TODAY AND THEY SAID THEY HAVE BEEN WAITING ON THE NGB TO RELEASE THE MONEY FOR ABOUT 2 OR 3 MONTHS NOW. THEY ARE SAYING I NEED A DOCTORS NOTE BUT THE DOCTOR I SAW IS IN VIRGINIA.
 
That tells me that something has fallen threw the cracks. Could be a required form wasn't submitted. Maybe the line of duty investigation wasn't approved by the Casualty Area Command. If I was in your situation I'd call my Congressman or Congresswoman. A higher headquarters (which will understand what is needed) will have to respond. They will find whatever is delaying your payment.
 
FROM MY UNDERSTANDING MY UNIT INFORMED ME THAT MY LOD WAS APPROVED BECAUSE IT HAD TO BE APPROVED BEFORE I COULD SUBMIT MY INCAP PACKET. I DON'T KNOW WHO TO CONTACT NOW OTHER THAN MY UNIT.
 
I can't count the number of Congressional inquiries I responded to in similar cases. When I called the unit they said they had an approved LOD. I then asked if there was an endorsement on the back that had the command line "REVIEWED FOR COMPLETENESS. IN LINE OF DUTY. BY AUTHORITY OF THE SECRETARY OF THE ARMY." And they said "Huh??" Many units think if sections I and II are completed, the LOD is approved. IT IS NOT.
 
I WILL CONTACT MY UNIT FIRST THING IN THE MORNING AND ASK THEM AGAIN. I CONTACT SOMEONE FROM THE STATE AND THEY SAID THEY DON'T HAVE THE MONEY RIGHT NOW.

Actually, you do NOT have to have a completed LOD to receive INCAP. They are supposed to pay you INCAP until the LOD is complete and either continue it or stop it based on the outcome of the LOD once complete:

6.4. Line of Duty Determination
6.4.1. Entitlement Prior to Line of Duty Determination. A Reserve component member who incurs or aggravates an injury, illness, or disease while in a duty status described in DoD Directive 1215.6 (reference (g)) is authorized medical/dental treatment under 10 U.S.C. 1074 or 1074a (reference (b)), as applicable, and pay and allowances as provided under Sections 204(g) or (h) of reference (c) while the line of duty determination is being conducted. The line of duty findings will determine eligibility for continued medical/dental care, and pay and allowances.
6.4.2. Interim Line of Duty Determination. Under regulations prescribed by the Secretary concerned, an appropriate approving authority shall issue an interim line of duty determination in sufficient time to ensure that pay and allowances will commence within 30 days of the date that the injury, illness, or disease was reported, unless there is clear and convincing evidence that the injury, illness, or disease was not incurred or aggravated in a duty status described in DoD Directive 1215.6 (reference (g)) and not covered under Sections 1074 or 1074a of reference (b) or Sections 204(g) or 204(h) of reference (c), or was due to gross negligence or misconduct of the member.

MY UNIT SAID MY LOD WAS APPROVED AND MY INCAP PACKET WAS ALSO APPROVED. MY UNIT IS CONFUSING ME CAUSE THEY REALLY CAN'T TELL ME WHEN I'AM SUPPOSE TO RECEIVE MY INCAP MONEY TO PAY MY BILLS AND RENT THAT HAS ALL FELL BEHIND BECAUSE I HAVE BEEN OUT OF WORK.

Have you contacted DFAS and inquired? As I understand it, per the quoted DoDI above, you SHOULD AREADY be receiving ICAP pay until resolution of the LOD/MEB (PEB).

Is the REVERSE of the LOD signed and approved as Ed stated?

Have you called your medical and finance people?

The Orderly room doesn't seem to be helping the situation much.

Perhaps if you have copies faxed to you, the landlord and your creditors will accept the documentation and work with you.
