The title says it all...

I thought that I was done with this forum. Though it provided me with a great deal of support throughout my MEB process, I was happy to walk away when my EAS populated and I thought that I would just be able to retire peacefully and be done with the process and I couldn't have been more wrong.

Just for reference, I retired on the 29th of June. However, long before that, I received a call from a VA representative who went over my rating with me (albeit, proposed) but a rating nonetheless and that's how I was informed that I was 100P&T. He asked me to send my DD-214 to him and I did and never heard anything back. That was April 28th.

I assumed based on my previous knowledge and research that the VA was simply waiting for my EAS to start making some movement on my claim. However, it's now been 37 days with no movement, no updates on VA.gov and no end in sight.

I did call at the 30 day mark post retirement to see if I could get an update and I was told by the VA representative verbatim, "I don't know why there hasn't been any movement on your claim. Your DD-214 is in the system but isn't attached to your claim." He then put a note in my file requesting that the claim be reviewed and told me to call back a few days later if no movement had been made. Well, as you would imagine at this point, 7 days later, no movement had been made and so I called back and was told, "We have 30 days to process these requests. If no updates have occurred in 30 days, call us back."

At this point, my anxiety is going wild and I'm conjuring up all kinds of things in my head...Did my VA MSC close out my case correctly? Did the PEBLO close out the case on her end correctly? Is there something messed up on the VA side that's causing my claim to just sit there and not be touched...

I'm hoping by posting this that I can connect with others who received their PEB findings in mid to late April and retired in late June to see if we're all in the same boat or if the situation I'm in needs more attention from outside resources. Thanks.

It sucks! You just have to be patient but at the same time every 2 weeks or so follow up. If it takes a ridiculous amount of time consider a congressional inquiry. That is the situation that my wife was in. She checked the box to get SBP up to the threshold amount but instead they took out full SBP. So her first retirement check $400 was taken out instead of $28. It took 3 months to get fixed and she ended up getting a 1k+ check to cover the funds they over collected. That was DFAS but its all the same with these large bureaucracies. The had the form in my wife's case too so it was so stupid that they took out full SBP amount when you could see the other box was checked and it was properly notarized.
 
Following. I ensured my MSC attached my claim by calling the VA consistently and getting 3 different agents to say they see my DD-214 attached to my claim. I scheduled a VERA appointment for the 8th, and my retirement date was the 30th of July. My claim posted on the VA tracker on the 3rd of August, where I was informed my case is in temp jurisdiction in Rhode Island.

If your claim has posted on the tracker, I suggest you download the VA Claims Tracker extension on Chrome, tells you anything an agent over the phone could tell you without having to punch in your social DOB and branch every time. The app also got updated to show on the front page when activity spikes.

The most concerning thing that I've pulled from what you have both said is that you have *active* claims in the system at one step or the other.

My claim has been closed since March 7th of this year (see VA claim tracker screenshot attached) but those were my proposed ratings.

No other claims have been opened since I retired, which is beginning to increasingly concern me.

Yeah I would definitely reach out to some kind of state representative. Someone dropped the ball big time IMO.

For the claim to not even show up... something doesn't smell right about it. If you call and ask what phase your claim is in, what would the agent tell you?

I'm continuously told that I'm at the preparation for decision phase within step 3. If they told you the same I would be less concerned, but I would still at least touch base with a representative.
 
**To my knowledge the end code of 310 means this is only pertaining to your proposed ratings. See below.

During the proposed rating stage, the Disability Rating Activity Site (DRAS) completes a one-time clear of EP 310 (with the IDES Rating – Proposed claim label)

No harm in utilizing resources available to you: you're not sending an army of police somewhere to check on your claim, you'd just be reaching out to a representative to do their job and represent you in your concerns as a citizen under their jurisdiction. That's what they're there for. Worst case scenario they look into everything and simply conclude everything is as it should be, best case scenario they find a clog in the pipe and unclog the process so you can get that backpay.

I assume you've already gotten your retired ID & enrolled in TRICARE correct?

Yeah, enrolled in Tricare through DMDC the day after I retired and the ID appointment is next week.

Hell, I'm even receiving DoD retired pay which compensates a little but it's not even half of what the VA disability will be...

If you begin to struggle financially I recommend discussing with NMCRS. They helped me out loads with a 0% loan. The VA also flagged me for hardship on my claim for the loan, so that could be a collateral help as well. Glad you're squared away with health insurance at least.

From my understanding, that is the proposed rating claim. I have that one as well and was closed on March 28, as soon as you retire, they are going to open a new claim the next day of your retirement date and that claim would be the final. MSC told me wait time would be 30-60 days, so i just hope we get our final rating ASAP.

This is exactly what I'm concerned about. As you can discern from my screenshots, that IS NOT what my information looks like.

What has me confused per this latest phone call with the VA is the fact that I gave her the claim number that I have per the VA tracker and she "confirmed" that the claim with that ID is pending final review.

I guess my question is if that's the case why wouldn't VA.gov or the tracker update with that information. Also, is it normal for them to use the same claim for proposed and final ratings or is it always two separate claims?

Man, this sucks. On one hand, I don't want to be an ass and push too hard on the VA, if they're truly doing their job but on the other hand, I don't want to keep getting hoodwinked and wind up with nothing 6 months from now...

Important: Before establishing rating EPs in IDES cases, the DRAS must ensure the participant’s service is verified and the EP 689 has been cleared.
EP 689 is the Control of the IDES Process which states that

Final IDES ratings are completed under EPs 110, 010, or 020 and are established by IDES DRAS.

Meaning this,

1. The VA call center rep straight lied to me when she said that my claim ID from my proposed ratings was showing in a "pending final review" state.
2. Something is seriously messed up between the IDES DRAS and my MSC.

Man, what a shitshow.
 
Mine is on 39th day and still on evidence gathering. Smh.
Keep in mind my timeline will look a bit skewed potentially because of the hardship flag on my claim. I believe the flag was placed the day after separation.

Those EPs sound right. My proposal ended as 933 because the schedule of ratings changed in the middle of my ratings, and they had to redo a part of my claim a day after sending a notification letter to my PEBLO. My final claim is under 010 currently.

I'm telling you, you oughta reach out and start seeking answers under the assumption something was done incorrectly. Inaction in these situations both during and post service never pay off, if there was ever a time to utilize your one bullet with this gun it would be on your final claim for award.

Claim finally updated today! It's been 37 days but at least we have some movement now.

20 August update.

The VA is really dragging their feet here.

Went into PFN yesterday afternoon but took 10 days to go from PDA to PFN.

Best of luck to those of you getting out soon. SAVE YOUR MONEY.
