When Am I Found Unfit? So Unclear Right Now!

Can someone please let me know when I am actually found unfit during this process? My PEBLO gave me a cookie-cutter answer basically saying my case should be completed by the end of June (package sent to AFPC 1 Feb 13). I have heard of many individuals receiving word of their fit or unfit status weeks after sending their package to AFPC. As well as being informed through each step of the process. Sounds like she will tell me when it is completed without providing any information along the way. My VA MSC also told me the e-benefits website is not reliable in regards to the IDES process, so contact my PEBLO for any unfitting information. It has been a vicious circle of "I don't know" and "contact [insert person/organization here] for further information".

I think the most frustrating thing about this process is they are not going through it, so they do not know what you have riding on the information you are requesting. How are you supposed to focus on moving forward if you do not know if/when to start moving forward. They really do not take any of this into account when blowing you off. I just wish there were more transparency within this process for the member versus relying on someone else to provide the information to you.

My apologies for the soapbox speech, but it is not good business to keep someone hanging out there when they have to prepare for this involuntary departure from the service.

Talked to AFPC today. Already have a lawyer assigned to my case (because I called the main office and had a paralegal enter my information this morning). We will begin working an advance adjudication. I was given this timeline from AFPC:

4 Days: PEBLO has to provide information requested by AFPC (med records, docs, etc)
3 Days: Attorney and member has to build and present case
1-2 Days: Results

If the results of the advance adjudication does not produce the results we are looking for, I can still go to Texas in front of the formal board. I'm glad they've added this option to the process. Money saver for the DoD as well! More to come...
 
My lawyer has been appointed and I have a 1430EST interview over the phone with him. Just to recap, I have currently have an approved package of 20% DWSP. My back (20%) is under category I, but my heart condition with pacemaker (10%) was not placed under category I. He is very knowledgeable and has my best interest at heart (no pun intended. I do hope he is able to work this out via advanced adjudication. I will keep you all posted. Fingers crossed!

My lawyer submitted my Advanced Adjudication Contention Slip to the FPEB on Friday, 19 Jul 13 at 1500. His brief discussion as follows:

"TSG ********** agrees that he is unfit and agrees with the IPEB finding as to the 3 presently identified unfitting conditions. In addition TSG ********* is asking the Board to add his Sick Sinus Rhythm with Pacemaker as a Category I Unfitting Condition at 10% at DC 7015. Our theory is TSG *********'s Tachycardia cannot be separated from his Sick Sinus Rhythm with Pacemaker. As noted in the IPEB, he continues to have issues with his pacing even post the most recent modification in 2011. We ask you to find this condition unfitting and recommend his Permanent Retirement at a rating of 30% if you agree with this extent of our contention."

I hope this justification works as I would like nothing more than to have this resolved without flying down to Texas. Nothing as of today; my lawyer is out of the office this week, but I was instructed to give the main line a call if I do not hear anything by the end of the week.

So, I just contacted the main office for the FPEB and my advanced adjudication was disapproved! :mad: So, I will be notified in the next week or so with a date at the beginning of Aug to meet in the FPEB. My lawyer is out this week, so I will not receive anything until next Weds or Thurs. I am truly fatigued with this process, but the end is near so I am trying to keep my spirits up. Also, I need an updated letter from my doc before that time comes and she is out of the office until 5 Aug. This is not looking good......:(:(:(:(

I am saddened to hear about the disapproval of your advanced adjudication contention! :( To that extent, please remember that the battle is far from being over! ;) You can do it; no worries, it's all good! :D

Now, it's time to concentrate all of your efforts on the forthcoming FPEB hearing. In the interim until the return of your PCM if she's not available when the FPEB hearing date is issued, are you able to obtain the updated letter from another medical provider at your medical treatment facility?

No one else works with your lawyer like a paralegal who could pass along to you any correspondence from PEB? Could you not see any other medical provider who could give an accurate update of your current medical condition(s)?

My doc is great and I think I have the best lawyer there as he was recommended to me by my current boss that sat on the board a year ago. He told me when this lawyer walked in, he always had his ducks in a row. Now, I have the two of them working together direct to line me up for a successful outcome. I am currently scheduled for an 8 Aug 13 hearing date for the formal board. I'm loading all clips and making sure my rifle's loaded and cocked. I AM NOT GOING DOWN WITHOUT A FIGHT! Wish me luck guys! She will be back the Monday prior to my hearing date of 8 Aug. She is great, she just didn't word the NARSUM how the board wanted, to she's working directly with my lawyer to ensure she properly outline my condition for it to be added to CAT I. I'm feeling good about this step; it has been a long battle, but I'm in it for the long haul. No one can give you a better outcome on your career than yourself!

That said, you are the best manager of your military career even during the DoD IDES process which is used to determine the fitness and applicable disability benefits of military service members with duty-related impairments.

Great news guys...I went to the formal board this week and I have been approved medical retirement!!!!!!:):):) The board president approved my contention slip without seeing me. He also stated my case is the reason why advanced adjudication was created. My case (with my heart condition) should have been accomplished during that phase. The Air Force should not have spent $1000 on me to fly out to Texas when it could have been approved before hand. I'm so excited! On to my family and our life post military. Thank you all again!:D:D:D:D:D:D

Now that my case is rounding the corner to the finish line, I wanted to share something. When my PEBLO came back to me with my 356 stating 20% DWSP in June, she told me this was a good deal and I did not have a good reason to request a formal board. Maybe I should think about a one time reconsideration. I say this because I will NEVER allow someone to make a life-impacting decision for me and my family. Do not allow your PEBLO, or anyone else, to sway you to make decisions that you may regret later. Go with what you know is right, stick to your guns, and don't give up on the process. You will not regret the outcome if you do that.

Nonetheless, never ever default acceptance to potential injustice while championing for well-earned and well-deserve military healthcare benefits now and after military separation/retirement!

To that extent, remain positively proactive and stay on course throughout all interactions in the DoD IDES MEB/PEB process while trying to secure the best solution for yourself and your loved ones!

As the historical statement goes..."you only have one LIFE to live"...and it's best to maximize all healthcare treatment opportunities while individuals are still capable to do so!

Unfortunately, I am not at that DoD IDES phase as of yet while in the U.S. Army. But, I calculate potentially another 30 days or so until receipt of my revised DA Form 199 which is the equivalent document to your 356.

In the interim, there are no worries for me and my family; it remains all good at this point in time! :cool:

Checked on the status of my orders as my PEBLO informed me that I should have orders NLT two weeks; my package is still sitting at the formal board and have yet to be sent to my action officer for ACTION! :mad: I have a final panel interview for a gs12 position at Quantico and I may not be able to take the job if I do not know when I will be heading out the door. I'm trying to be patient and move forward as I can, but it's not easy when you are always considered to be a stat and a timeline versus a person trying to transition and make moves for yourself and your family.

Indeed, this is a temporary setback but when did your PEBLO state that your IDES case file shall be forwarded to TRANSPOC for the generation of military retirement orders?
