    You need to see a disability attorney and a NLSO attorney before you accept any findings. Where are you located???

    The system is not perfect. However, you all should be thankful the system is in place. Most people in most positions don't have access to a system like this that compensates them for disabilities NOT cause by their job.

    Did you ask the board to reconsider your fit finding? If so, and your case is at the VA, it means they granted your request for an unfit finding and are now rating your case.

    How long ago did you sign? If your case has not been sent to Navy personnel you can rescind your signature. Contact the PEBLO or better yet the JAG that works in your area on these cases. Where are you?

    When does your enlistment expire? If you are enlisted to 20, then accept the findings and go have your surgery. If not, then you need to appeal. There are JAGS that can help.

    Why aren't you accepting and requesting permanent limited duty??? You won't be denied with 19 years.

    Congenital conditions are not ratable through the PEB process unless you have 8 years of service or evidence the condition was aggravated by military service. Being a Marine, I'd think you'd have a shot at service aggravation. I would ask your doctor to generate an opinion re: service...

    PEB Question

    It depends. Generally no because PEB is an extension of LIMDU. However, I suppose if your medical condition did not prevent you from taking the PRT you would still take it. Neither the PEB nor LIMDU will get you out of the body fat/weight requirements though.

    There are Navy JAGS at Balboa and 32nd steet who have been certified in the PEB process. The ones at Balboa are in building 26 across from the PEBLO's office (619) 532-5605. Send your son there to get more information on the process in San Diego.
